Hi an investigation has to be carried out before the finger of blame be pointed at you. For them to tell you that you were at fault when filling in the erica is wrong. Get your h&s safety rep involved and never go into the office with your manger on your own

Without this forum I would have been stumped a few times now.

I'll deal with this on Monday
I called the number on my membership card and they said to try my rep too.

The guys snowed under so I'll prepare a document and ask him to pass it along the chain for me.

As soon as I saw contempt of court the alarm bells started ringing
Poor lino when I stated a refusal,then explained why I had to cut off.

After a RTA notify the manager, He/She will then Complete a Erica report and submit it , You then sign a copy.
After you have done that you will receive a letter saying blameworthy or not check out the rta procedure .

Turns out my lino is one of the good ones

He followed procedure

And agreed it was a 50\50

Which I am happy with
To be on the safe side and to tighten up other aspects
I'm calling the branch legal chappie tomorrow

Might i ask what was this form was you were asked to fill in. Mentioning may lead to contempt of court on a non judicial publication is very serious. Especially if it also states failure to sign to apportion blame will invalidate PACE

The right to silence and self incrimination is a common law right and also covered under Article 6 Human Rights Act

Form was royal mail
Branch called me today and explained
The contempt was basically a disclaimer/cya
As far as pace goes.......
I could pick holes in the procedure all day long
....I covered my back by mailing my branch and by ensuring ....and I know I'll get stick lol....a decent lino done the investigation part.

However if it had been anything other than a minor 50\50
I would have been clammed up tighter than a ducks bum


The other drivers insurers have not been in touch
