You don't file a grievance for B&H.
It's a formal complaint to HR, fill in a H1 form.

The reality is that HR decide its not an HR1 case sometimes so tread carefully.

The reality is that B&H is open to interpretation, intentionally, just so they can do these types of things.
But, quoting passages from the rulebook at them should help. As well as informing them they'll be the target of the next complaint.
It isn't for HR to decide really.

I think many are confused as to what actually is B&H, staff, managers and on occasion HR too.

"Harassment is any inappropriate and unwanted behaviour that could reasonably be perceived by the recipient, or any other person, as affecting their dignity".

How can HR tell anyone they're wrong? When it comes down to perception?

I was IHR. Was offered it and took it. Glad to get away from a job I once loved.

It is not that subjective - there are behaviours which constitute B&H and ones that do no not, the standards are pretty clear. Provided the investigation process is followed correctly, to time scale by a trained investigator who is allowed to complete the task in an objective and fair manner (without being leaned on by management) it will work ... but my experience is that the process breaks down in a large number of cases and that is why outside expertise needs to be brought in not merely to mediate but to undertake the investigations. B&H is a very serious problem within RM at all levels of the structure.

During my time at RM I worked with some excellent CWU safety reps many of whom were more knowledgeable and keener than their managerial counterparts. Isn't it about time that CWU considered appointing area reps who specialised in B&H/Discrimination to provide advice/support and monitor casework ?

Having recently had a stage 3 grievance hearing i seriously wonder why anyone bothers!

Our Grievance was over both national and local agreements being broken within our office by management.

The stage 3 hearing went well and i can say quite honestly that i was surprised that the person sent to hear our grievance was sympathetic to our case.

Just this week my DOm had a quiet word with me to say that we should hear the final outcome sometime soon, but did i realise that the person dealing with our case would have little say in the final outcome. That powers much higher would dictate a response to our grievance and that would be the end of the matter !!

Now i din;t honestly expect much from this to start with, but if this is the way it's dealt with, then why do we bother and why is the procedure in place in the first place?
more importantly - why are RM allowed to get away with these things?
These are national and local binding agreements being openly broken.

If anyone wants to know more details there are other posts by me about this.
