IMO CWU should have only agreed to 'Flexing' provided that a mechanism was put in place to allow all DO staff the opportunity of opting in or out to this system of resourcing. Once you have opted out ... no more taps on shoulder, no more managerial time wasted approaching staff who are no willing to work over their time.

The Working Time Directive Waiver is used by RM to allow workers to agree to work longer than the 48-hour limit. It can be for a specified period or an indefinite period - there is no reason why a similar system could not be developed for flexing.

Not very new start then is it,Uncle Dave and the top table said that the management would all change and be reasonable, maybe he should have said that some reps should just feck off as they are obviously militants. :hmmmm

goinpostal wrote:Anyone had these new Fairness, Dignity and Respect joint briefings? The rep and manager together are supposed to read out these different scenarios. Cant believe that union negotiators have signed it off, it has a big bit about how workers shouldn't make a fuss about the 30 minute flexibility rule without explaining how this is meant to be exceptional, just that you do it whenever traffic is unexpectedly high. Worse it has nothing about working to your time, when that's the biggest sore point between workers and managers and has caused all sorts of trouble, suspensions, strikes, walkouts over the last year. Talk about officials pulling the rug out from under us.

On that note any news from the delivery review?
Just say you can't flex due to personal reasons , You need to finish on time etc. If they keep
asking why, Say "its personal", Then raise a grievance if they keep asking........Dignity, Respect, Bullying and Harassment.. :nana Tell them to Jog on :wave

If they ask me for a reason I'll just give them a big middle finger. Shouldn't EVER have to make up excuses as to why you want to finish on your time and I never do, I simply tell them I'm finishing on time and that is that.

I'm sick to death of management at all levels.

The FDR briefing only uses flexing as a scenario. It is NOT a roll out for flexing to be used where it currently isn't... End of (:

I informed my Area rep that I won't be doing the CWU statement for the coming WTL, Area rep said he'll come over and do it. I think HQ have forgotten who is actually having to deal with these things. It's sad to say, but as RM are even more money driven, when push comes to shove DSMs are just going to revert to type e.g. it will be done. I'm willing to be proved wrong though, we'll see how it looks mid summer.

I'm sure it isn't.
Doesn't make them right.

Anything and everything is open to interpretation.
As usual, RM and its management minions will use it, if we allow them to do so, to their advantage.

TOTAL HOURS WORKED?

MONDAY- 60 minutes early

TUESDAY- 30 minutes early

WEDENSDAY- 30 minutes over

THURSDAY - 30 minutes over

FRIDAY - 30 minutes over
-------------------------------------
(A) no overtime paid

(B) 60 minutes overtime paid

(C) 90 minutes overtime paid

if (A) is correct then what is the incentive to work overtime wed/thur/fri unless flexing/overtime is compulsory and can be applied retrospectively

if (B) is correct then does that mean that 30 mins flexing is bankable

if (C) is correct then is flexing an either or option to booking overtime.
------------------------------------------------------------------------------------
(D) none of the above!

Anyone got a copy of the hymn sheet the two parties are singing this from? Might be handy to see the size of it before suggesting which orifice they jam it in.

I'm sorry but this is the bit that starts to raise alarm bells. Staff are entitled to a private live outside of RM, one which the business does not encroach into or have any right to information about (safe for the obvious). A single man with no ties has the same right to work his contracted hours as one with 8 children (all of whom have to be picked up from different schools). To even suggest that staff members need to start providing reasons and provide some form of evidence as to why they do not wish to work over is a form of intimidation ... black books may not really exist in desks drawers but they certainly do in the minds of some Line Mangers & DOMs.
Spot on mate.

I offered to flex once but the offered me the 30mkns back in the morning I said no sorry I'm giving it to you at the end so I want it back at the end another day, they need te favour but try to give us the crap end of the deal.

What Bob Gibson needs to do is confirm if flexing is compulsory or not or is it an offer of flexible working that you can choose to accept or reject on any given day without any consequences if you reject the offer.

Employment law says an employer can not force an employee to work over their contracted hours unless it states its compulsory in your contract.I don't see the word compulsory in the agreement.

You have to ask if the CWU/Gibson cant clarify how this is to be implemented in a point of clarification then what are we paying the f***ers for.In my area they have been banking hours on and off for years and now theres been instances of 'punishments' dished out if you don't flex up on any given day-ie; you didn't flex up last week and now its a light Monday and everyone that flexed up the previous week gets to go home early while work is 'found' for you to work your contracted hours. On top of this if you have kept 20 mins M/R to take at the end of your duty you cant sign out 20 mins early but have to sit in the canteen for 20 mins then sign out.
