Just make sure you request from Atos a copy of their findings/summery. This will let you know what your DOM actually gets. Otherwise your DOM may well word things to his favour.

ATOS will send you, and the DOM, "a copy of their findings/summery" anyway. :Very Happy
But before ATOS phone you spend a while to get clear in your mind what's wrong with you, what work you can't do, what you might be able to do, anything else that's relevant, etc. and, with a bit of luck, ATOS will agree with all you say and it will all be included in the report they send to your DOM who then will have to suggest something acceptable to you. :Very Happy

If a request wasn't made over the phone, staff would not receive a copy.

Also, you should request a copy of any further future correspondents between your DOM and Atos. As we a starting to see unsatisfied DOM's going back to Atos and influencing there decision to encourage an earlier return to work.

But it's you, not the DOM, who is ill so it's you, not the DOM, that can tell ATOS what you can and can't do, when you can and can't return to work and what you can and can't do during a phased return to work.
When booking the phone interview the DOM might have suggested unrealistic things to ATOS that they will then put to you but this shouldn't "influence their decision to encourage an earlier return to work" if you've thought in advance what to say and you make clear to ATOS what is realistic and acceptable to you.

It happens. Trust me. Dom goes behind the back of the individual with Atos and comes up with just enough to get Atos to agree an earlier return to work. This is then enforced onto the individual by the Dom as it now has been agreed by Atos.

We all know what should and shouldn't happen but we should all be aware of what a Dom will do to get what he/she wants.

Your experience is different from, and worse than, mine then.
I agreed with some, though not all, of what ATOS suggested and the outcome, though not what the DOM originally had in mind, was acceptable to all. :Very Happy

Sounds worse and worse the more I read. Obviously I cannot go in to the precise reasons why I'm on the sick but it would be impossible for me to return to work with my current mental state.

As far as i know the return to work arrangement has to be agreed between all three parties.
If the employee disagrees with the outcome then there is no return to work :so there

You would think so but sadly this is not always the case... Have a look in Union Room. We have someone who has had their pay stopped by their DOM, despite being still signed off by their GP.

Atos have their faults but my experience has been positive. After 5 months off following shoulder surgery they suggested a 5 week phased return which my Dom followed to the letter.

That's good news for a change.
Have a read of this topic, see the other side of the coin and imagine how different things could be if this was your DOM
