What does the smoke-free legislation say?

Under the legislation it is a criminal offence:

for employers or managers to fail to display the required no smoking signs
for anyone to smoke in a smoke-free place
for employers or managers to fail to stop a person smoking in a smoke-free place

There are limited defences if it can be shown that the person responsible did not know and could not
reasonably be expected to know:

that the required no-smoking signs were not being displayed
that the premises were smoke-free
that a person was smoking in them

It is also a defence to show that the person responsible took reasonable steps to stop a person smoking, or
that on other grounds it was not reasonably practicable for the person responsible to comply with their
obligations.

Penalties for non-compliance

Local authorities are responsible for enforcing the smoke-free legislation in buildings and other premises.
The following fines apply for non-compliance:

failure to prevent smoking in a smoke-free place carries a fine of up to £2,500

smoking in a smoke-free place carries a fixed penalty of £50 (£30 if paid within 15 days) or up to £200 if
awarded by a court

failure to display the minimum no-smoking signs carries a fixed penalty of £200 (£150 if paid within 15
days) or up to £1,000 if awarded by a court

Aside from this, employers who fail to prevent smoking in smoke-free places are likely to be in breach of
general health and safety legislation.

They shouldn't be smoking on RM property full stop, the filthy tramps (sorry, smokers) in our office have to go outside the gates to get their extra 20 minutes a day worth of breaks.

That shouldn't be permitted, all motorists passing a Delivery Office see of employees there being skivers doing nothing but smoke. :sad:

smoking inside any company van is an offence people have been taken to court for this offence

Well it is what it is - buy a mask from boots, as for the smouldering leave your frame and wet them down. We had a bloke who when smokers congregated at the door and smoke "wafted in" he complained to the DOM that he was "nauseated" by it yet thought nothing of spending hours in a smoky boozer - says it all really.

All you should need to do is to telephone your local Environmental Health Office and ask them to deal with it.

Let me put it more succinctly then - it's a problem for you but you don't want to raise it in case people find out it was you :crazy: - in the case I quoted he at least had the bottle to approach the DOM and in your case you have legislation to support you.

I would be more concerned with all the diesel fumes from the vans wafting in than a bit of cigarette smoke. This will kill you before a before second hand smoke will.

Yes Barbel you took the words out of my mouth this morning I had some clown with a key in the ignition engine running warming it up defrosting his/her windows and unattended so it was a double whammy this morning. That I will stop and report all to make about 5 or 10 mins up to get home .
