This is exactly what we do now but our manager wants us to take a break before we go out rather than in the van is this enforceable ?
Yes he can tell you when to take your break but not where.
However, he should also be acting in a fair manner with everyone. If he is enforcing break times. he should enforce it on EVERYONE.
Rep should deal with it, or if not, then someone will need to stick their neck out and perhaps go toe to toe with the manager (in an official and respectful sense).

No,they're the ones getting paid overtime before they have finished their normal hours.
the answer to your question is yes your manager can make you take your break when he wants but if hes only doing it with the ones who cut off then that seems like victimization! get your rep on it!

no probs! if he is only selecting a few who he is telling when they must take their break and letting others take it when they like and im sure others are getting away with having no break at all then that to me is victimization clear as day! I would put a grievance in, better still your rep should get you all to put one in & get the area rep involved so everyone is treated fairly!
If your scheduled break is before you leave for delivery then you can go and sit in the van to take your break and then come back to the office
Basically, you are arguing for taking your break on delivery - the answer is that the manager can make you take a scheduled break before your delivery...

You can be made to take a break before you go out.
But, people cannot be separated into two groups in the manner that has been described.
It applies to all, or none. Otherwise, it's discrimination.
The updated Code of Business Standards might be worth a mention.
It does state that managers should fairly treat all staff in the same way......
Plus, if it were me, I'd merely say no problem. But I'm taking the full 40 minutes.

This is ghost overtime which is fraud and the management allow this to happen.
Is this happening elsewhere?

ghost overtime is not fraud if its agreed to by the DOM
Was told by my union rep you have to take it before you go out but they the management cannot tell you when to take it before then so that is the answer as to further reference the "Way Forward Agreement"

Well it's certainly a practice that's against business policy so you could question whether a manager actually has the authority to agree it..
I think there was a manager sacked recently in one of the MCs for paying people for overtime they didn't work....he was allegedly taking a cut of the proceeds I think but I would imagine it would be enough for Royal Mail to know they were paying good money for nothing to throw a few P45s around and where the money actually ended up would be a minor technicality.
