Be careful because the position management will take is that you knew the yard was unsafe so why did you attempt delivery?
The final decision on whether a delivery point is safe and whether you should attempt delivery is always the OPGs.

i have reported the problem and so has other collectors who have been there as when I spoke to my union rep after my accident Saturday he said the area h&s rep is already aware of this yet nothing seems to of been done with regards to the business sorting out there disgrace of a yard

as I said previously it is normally safe enough to go into the yard load up and drive out but they have stuff piled up each side. a metal bar had fallen away from the pile which resulted in me spraining my ankle. it is the companies fault for not clearing the crap in there yard. have told my manager before I wont be collecting from there I just get told its a big customer I have to or they will lose the business but have told them now until it is sorted I will not be collecting anything out of that yard other companies collectors have complained and still they refuse to sort it out

If you think the area is dangerous then you don't even bother entering it, they can say anything they want but you've risk assessed the area and deemed it unsafe. If the want you to go onto the premises then get it in writing and then complain to the H&S rep and have it brought up with a senior manager.

Damned if you do, damned if you don't.
Have some parts on my delivery like that, a couple of whole streets become extremely slippery when wet (they are on a steep incline), you may as well put on roller skates. If I slipped on my backside walking down it, i'd probably be told it was my own fault for attempting delivery. Yet now the wet weather has set in how would management take it if i returned the whole street every day for 4 months or something?
