Atos reports ignored by DOM

Hi all

I have been off work for 6 weeks with injury, spoke to atos 5 weeks ago and they recommended Royal Mail physiotherapy, the Dom was apparently off but came back two weeks later and wrote a letter to me saying to call him so I did and explained the situation and told him what atos had said he told me he would get on the case ASAP the next day, that was over two weeks ago and have heard nothing since from either of them. Wrote an email to my union rep and he said he will discuss my concerns with the Dom on Thursday. I thought managers had a duty of care towards employees, this is not the first time he has ignored an atos report of mine, is there anything else I can do? This seems like blatant ignornance to me for which I have had before from him.

Yes got all copies of atos reports, got a missed call from the Dom earlier with a txt afterwards saying please contact me regarding your absence, I texted him back saying I can talk in person when my rep is there. Then received another text saying to please call him. I refuse to bullied into contacting him.

I had exactly the same thing, ATOS report ignored by my manager ended up going sick again and now finally back on rehab but being sent to other offices coz he's over budget.

Feels like I'm being punished for being ill, it doesn't exactly help my re corporation being made to feel like trash for being ill.

Good luck with yours, makesure you use your union rep that's what you pay your fees for !!

my union rep has been at another office for ages, emailed him last night and he said he will speak to the dom on thursday with my concerns, good luck Lou thanks for your reply

My Dom did this with me.He questioned me my GP and atos.I raised a greivance i took it to stage 2 it was partially upheld.When i tried to get it taken further ie putting pressure on HR. No less than 3 conduct issues against me.This in turn brought about my dismissal over 3 years ago.It wont go away even now .The individuals that colluded and fabricated evidence best hope i dont cross there paths as i wont be responsible for my actions

I would email your Dom, copy in your rep. Politely ask why he has failed to carry out the request from Atos. Attach a copy of your Atos report.

Keep in contact regarding your absence regularly. A phone call will be adequate.

Atos make recommendations...

Royal Mail don't have to follow them! Usually they are used against you, not for you, sadly!

DOM are not trained medical practitioners they would be legally liable for making Medical decisions they are not qualified to give, as simple as that.

Does that include rehab plans that Atos have recommended too?

Should Management take heed of them, also?

my dom initiated all the atos phone meetings.
he even handed me some of the atos reports.

funny though he didnt hand me one in particular....which had recomendations.
I didnt get this report sent to me either ..i must ahve forgotten to request it because id had so many phone calls with atos lol

so he had handed me a few reports and told me there was nothing wrong with me apart from stress.

so a few days before the tribunal start date i finally got all my atos reports ....just thought id have a recheck as i had noticed this one phone call from atos didnt have any report sent to me....lucky i had mentioned it in my series of events

so 3 days before i insert the new evidence intot he bundle

judge ask pat doherty had he seen this report

i pointed out that he had scheduled the phone interview

it blew his whole story apart.

the investigating manager and the appeals manager said they looked into my atos reports.......

their questioning on one important issue was not a direct question and wasnt investigated. and coupled with the report it gave me a 3-0 3-0 victory in court....job back plus all back pay ....holiday pay back eventually (yes they even tried to stitch me up on that dirty *****)
then had to go off sick for 8 mpnths because the back couldnt handle the work after having too long off....had a really bad spell with back problems whilst off sacked.
then got IHR.

all because one manager "forgot" a report ....thats about 40-45k extra i got for doing nothing

I had a knee op 2 years ago. Went back on light duties, ATOS recommended, DOM tried to ignore. I would not defer from the ATOS report, so he had to abide. Do not allow this it will do you no good in the long term. Be brave and stand up to you DOM.
