There is clearly some division as to what peoples understanding is regarding a part timers break at the end.

Had about 20 different answers...

Who would officially have the final word on this?

According to 2010 its under health and safety section. - Appropriately scheduled meal breaks ( consistent with relevant working time legislation). This hyperlinks(which i guess was intended to be read online by email ) to the the MEAL BREAK information in 2000 which states under any attendance that only has one break it must NOT be taken at the end.

I would say this is pretty straight forward then? :left:

Fishtank probably.

Either your office has agreed to this or it has been imposed (by executive action)
You then as CWU members have to get your rep to go to disagreement.
If he gets nowhere you go to stage 2 where your Area reps get involved.
No joy and it is stage 3 with Divisional reps.
No joy and ballot for industrial action.

Though that all seems a bit of overkill.
If an accident/incident has already occurred on delivery then it should be dealt with by H&S.
And laughably (not) so many of our colleagues skip their break so they can finish that little bit earlier......
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

The only thing confusing me is what you want.

Management's position is that they want you to take your break at the end.
Your position is that you don't want to take your break at the end.
The union supports your position as per the Way Forward Agreement..
After that you need to make things happen.

You seem to want a legal judgement signed by a high court judge and verified by the Queen before you fight over it.
Just go to war with your manager and worry about the semantics later.

Well im going in with this

According to 2010 its under health and safety section. - Appropriately scheduled meal breaks ( consistent with relevant working time legislation). This hyperlinks(which i guess was intended to be read online by email ) to the the MEAL BREAK information in 2000 which states under any attendance that only has one break it must NOT be taken at the end

Just not sure how i am going to explain the hyperlink part.. but i think i will laugh anyway because its quite comical

Hes stating something and im telling him to check the hyperlink in what hes saying :left:

2. Rules for taking breaks

Employers can say when workers take their rest break during work time as long as:

1.the break is taken in one go somewhere in the middle of the day (not at the beginning or end)
2. the worker is allowed to spend it away from their desk or workstation (ie away from where they actually work)

If an employer says a worker should go back to work before their break is finished, it doesn’t count as a rest break.

You should take a break somewhere in the middle of your duty for H&S reasons alone, You need food and fluids in your body.
This should be reported to your area rep and H&S rep asap.

only issue for this is that for a part timer working less than 6 hours there is no legal right for a rest break, so if an employer gives you a rest break he legally can schedule it any time he wants as its not a "statutory rest break" which must be in the middle
Not so if he/she drives a royal mail vehicle after five hours you need to have a rest break if not you are braking the law of the land if your DOM insists you do so get him to put it In writing he would not be the first fool of a manager to be hung by his own testimony.

That's not true, if he is on deliveries as we are talking about, the laws on drivers hours rest breaks don't apply to small vans

They do all driving even if you drive your own car you cannot drive whilst tired it is an offence and you could be banned from driving and sent to prison if you injured someone yet alone killed someone these silly managers think they will blame you put the ball in their court!

Pretty sure that only applies if you're actually driving for five hours which would be an interesting delivery.
I actually drive for about 35-40 minutes on my delivery and the van does about 10 miles in all.

but theres no law saying you must have a break after x amount of time if driving a small van,

it is not an offence to drive whilst tired, your making that up, though doing so would increase the chance of committing an offence like dangerous driving

he is confusing it with drivers hours regulations for lorries and buses, they are required to take a 45 min break after 4hr30 min of work. that includes non driving work, so if he did 2 hours of indoor then started to drive a hgv he would then need to take a mandatory 45min break after 2hr30 driving, but these laws dont apply to small vans used in deliveries
