help for an ex employee/union member please!!

hi royal mail are taking me to county court in nov for over payment of wages..... firstly i left royal mail in oct 2011 after 8 yrs service (union member throughout!!) they then kept paying me weekly after i left for bout 4 weeks.. i did inform my ex dom and he said they would get in touch.. however they never did! i never heard anything form then again.. then on this tues £243 was taken frm my bank by a court order... was i shocked! i got in touch with my bank etc and i finally found out it was royal mail..they have a court order and i am due in county court on 19 nov for overpayment of wages..... they started proceedings in march 2013! and all letters was sent to my previous addy, so i had no idea they was chasing after me... anyhow yeah i guess i still owe the money but i moved home over 18months ago and up untill then i had no contact from royal mail..it took them fro oct 2011 till march 2013 to start a claim against me! surley they had enough time in the 18mths between i left royal and than moved address to contact me.. anyone else know anything similar to this? thanks for reading

Not completely sure but I think they can chase you for overpayments up to 3 years after the date. But I could be completely wrong, I'm not lawyer.

unfortunately your going to have to pay this back, i would get in touch with the court that issued the order to try and set up a manageable payment plan

Not completely sure but I think they can chase you for overpayments up to 3 years after the date. But I could be completely wrong, I'm not lawyer.

I'm not a lawyer either, but I don't think that is right. I believe you can be taken to court for a debt for up to 6 years (if not longer).
But you do acknowledge you do owe RM the overpayment so zx135 is right, contact the court and set up a payment plan, or costs could escalate.
Sounds as if they already have a court order against you, and have taken some of the outstanding debt from your bank account, so I don't understand why there is another hearing on 19 November, unless there wasn't enough money in your account to cover the full debt. In that case they might be going back to court to recover the balance, and perhaps get bailiffs involved.
If bailiffs get involved the costs can escalate rapidly, so I'd sort it out asap, with an agreed payment plan.

Random question but obviously since Royal Mail would have your out-dated address (if you have a driving license is it up to date with correct address?)

daaav yeah i updated my licence soon as i moved here.. cant understand how they could not find me..they had my NI num and my bank details... thay have their own investgators dont they

hi thanks for the replys... no there wasnt enough money in my account, the £243 they took (plus £55 fee) almost took my account to zero! i am already in a debt management plan so i have no funds to pay a lump sum.. i have been in touch with royal mail solicitors via the phone and asked if i can repay £50 a month.. they are putting this to roayl mail and will let me know... so hopefully i wont have to go to court... or i could go to court and show them i have no funds and maybe even pay less a month... just a bit unfair they took over a year to try and get in touch with me... anyhow thanks again for the advice, and despite all the probs you guys are having with royal mail, i still keep an eye on this site.. i do kinda wish i never left.. great bunch of guys on the floor, just the management that is spoiling a things...

Although DVLA and DSS might have your new address, I doubt that Royal Mail would be able to access their computer records due to Data Protection Act, but they would know your Bank Account details, as your wages would have been paid into it, so it would have been easiest option to recover money.
I would try to sort it out and get court case stopped or you are going to incur further court costs.
