Been charged with gross mis conduct. Some relief manager said I spoke in an aggressive manner to him. [He was baiting me...... BUT
He has said I came across as threatening.. two co workers in office have said I have also been aggressive with them as well
many months ago .....this has whats been said in the letter I received and I need to attend interview to put my side across.
I had very brief fact finding thing and was suspended a while ago and now this interview with a dom from other office has come about.
I totally re fute these allegations and cant beleieve that two of my co workers have stuff the knife in. The question is can they dismiss me at this stage

Were you represented at the fact find? I would write to Royal mail prior to the hearing and request further information on what at the moment is purely a manager using third party inference to support his case. Ask for dates, details of what you were supposed to have said, and whether there are any independent witnesses to support, and why this was not brought to management attention at the time. Were there any independent witnesses to support the managers claims, and also note down what he had said to annoy you. Had he baited you before? Make sure you get everything down so that you can give a clear account of what happened.

Not a justifiable reason of course, but might this have arisen because, in your own words "I am one of the very few maybe the only one who will refuse to work over my time" and " I leave items in the frame. I am seen as trouble"? :shock:

I feel there is a concerted effort by Royal Mail to try and sack or intimidate Postmen that do the job correctly into leaving and in particular if you cut off. This is most likely due to their wish to privatise us, and pay peanuts to run a shadow service.
I say this because I personally have been targeted this way with a string of visits to "explain my actions" at several fact finding interviews over the last 6 months, none of which resulted in any action against me. I am at this time awaiting yet another result from a fact finding interview that claims I ignored a managers instructions. I dont want to go into details but this latest scatter gun approach to trying to trip me up has absolutely nothing to do with how I conduct my job, because they now know I cannot be found at fault that way. Me and others have in that same time been dragged into the office and forced to sign various statements relating to minor rules around the office, stating that we know that we can be sacked if you do not do something in a growing list of petty things. I have worked for RM for more than 20 years and I have only ever been into the disciplinary routine twice, until this year and I have now had four fact finding interviews just this year!
I think they would be happy for people to leave citing constructive dismissal because they want to get rid of certain old lags, like myself and would be willing to take the small financial hit of paying out for constructive dismissals rather than have people standing up to them. This sounds A bit like conspiracy theory I know but from my point of view they clearly want rid of me whether by building false cases against me or making it impossible to do my job by making it so unpleasant that they hope I would resign.
This sounds like this kind of intimidation, and I hope you can stand up to it

I think its just an on going process to cull the workforce (especially old heads) of what they perceive to be troublesome employees.. especially now of course during times of privatisation. And I think your right they would probably rather pay out compensation for constructive dismissal just to get you off the pay roll. I fear the conduct code will now be adhered to in such a way to suit them....even though they break nearly every rule in the book :no no

I think you have a reasonable case of harassment and intimidation. Four cases in a year, all of which have come to nothing.
If I were you I would give Acas a call and ask for their advice and opinion, and a trip to CAB would also not be a waste of time. You need to defend yourself at the same time if you have not already done so seek CWU help. If I were in your shoes I would be getting very DEPRESSED and ANXIOUS with what is going on.

Yes I am depressed and anxious and I am considering a B&H case, but I know its very hard to prove that sort of thing, so I am still gathering evidence but realistically all I want to do is just do my hours go home and forget about it.

not a lot wrong with the above. r.m want no perm full time staff and will find a way to get rid of as many as poss one way or the other. if you are a full timer with a perm contract then i suggest you find another job before the brown stuff hits the large fan
