Ind Injuries Benefit

I get a Ind injury Benefit each week, due to accidents at work

I have a claim going on for nearly 4yrs in which is now coming to be finalised but there are deductions.

. CRU recovery I did not know that the monies paid Ind. injuries Beneto me, has to be recovered back, is this true it is nearly £ 2 hlf thousand pounds they want out of my compo ( as in another case I had where I was partially disabled with dog bite no monies was recovered, why this time . I dont see why you should have to pay this back out of compensation, especially when the accident is not your fault

know this one is right, but it gets me everytime royal mail recoving sick payments £1,500 ( why they dont chase this up themselves I dont know)

Strange, i get around £80.00 a week industrial injuries. I cant remember if they took money out of it but if they had im sure i would have remembered!!!That started about 10 years ago!!!

dont think anything should be taken from you i get 120 amonth and don't even have to tell anyone about it

Unpopular but true. If you had an AOD and it wasn't the business's fault then i assume you are claiming against A N Other. The business has in this instance (for want of a better description) subbed you the money on the understanding that if you are successful in any future claim you will pay them back the wages they have paid you.
A claim should be made up of at least
1. wages
2. Loss of earnings e.g SA held or your average o/t performed in the 13 weeks prior to the accident.
3. Pain and discomfort. Apparently there is some sliding scale solicitors use for this.
4. Extra costs incurred. prescriptions, taxi journeys, any extra care required.
if you are unsuccessful then the firm get eff all.

One perk that i have successfully argued is that if you have had time off this time should not be included in ANY attendance procedure as the business has not lost out financially nor incurred any extra costs so in essence the absence was special leave c without pay.

I was asking more about C.R.U. where I have to pay DSS back, because of the Ind injuries benefit I have recieved
