"The no strike clause"

Post by gb93 »

What are the facts about this clause in the RM pay offer.
Both sides are giving very little information about it.
Depending on the full facts of this "string" this alone is enough to halt any agreement no matter what else is in it.

The no strike clause isn't a no strike clause.
The £300 lump sum is dependant on no industrial action being taken.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

Can someone explain what changes they are going to be to pensions? The way I read the stuff they send out there aren't going to be any changes for three years. Have I read it wrong?

So the "no industrial action" clause only covers the £300 lump sum up to christmas.
Not the whole 3 year agreement.

There is also the nebulous "Industrial stability" they want us to accept as part of the pay offer as well. Apart from the fact that no details have been released I suspect that this is a No Strike Clause in all but name.

Yes, similar to that introduced in Canada, I believe - not sure if only related to the postal business or business in general throughout Canada :hmmmm

In essence it meant you could take industrial action BETWEEN agreements, but not during the lifetime of an agreement :cuppa

If this is a fact & the agreement RM are offering means no strikes for 3 years if agreed by CWU & members.
Why isnt it being shouted from the rooftops by HQ to the members non members & media.

As per the latest 'What privatisation means for you' propaganda leaflet the 3 year deal is until March 2016 - the deal on offer by RM will therefore soon have only 2 and a 1/2 years to go. Ok we want the pay backdated but the terms and conditions offer that the RM keep drip feeding us, both at work and at home, is just until March 2016, not from the date when any deal is struck with the CWU.

Time the CWU got this message out there !

This point brings into sharp focus a thought I had.
If we leave the company within 3 years of getting shares we lose them.
So if the 3 year deal goes upto march 2016 it will be another 9-12 months before we can cash them in.
RM could tear up our current t&c and blackmail us into accepting it by saying we will lose the shares if we dont accept new employment contract.
Sign a new contract with far worse t&c and keep your shares or dont & its the dole que.

The shares will be held in trust, by a company called Equiniti. Royal Mail would not be able to do what you are suggesting. Share Incencentive Plan (SIPs) - not just the one RM are proposing - have very stringent rules, as set out by HM Revenue and Customs, regarding eligibility, whether and when tax is payable on 'cashing them in'. It is perfectly understandable how a company would want to deprive an employee who was dismissed, for gross misconduct for example, of free shares.

They cannot, however, suddenly decide - unlike with the ColleagueShares scheme - that the shares have 'zero value'. Once the shares are listed on the London Stock Exchange, the share price will fluctuate, but whatever the share price is at any given moment, that share price is the same for every share of Royal Mail Group plc, whether those shares are held by a pension fund, private investor, or trustee.
At worst, RM could - perhaps - buy back the entire 10% of shares allocated to the scheme, and force Equiniti to pay us the value of shares, less tax and National Insurance. But they cannot, if the flotation does go ahead, just make the shares worthless.

I did not say they would say the shares are worthless.
I said they would offer us an inferior contract to sign to remain employees of RM.
And if we did not sign we would no longer be employed by RM by our own actions therefore forsaking the shares.
At the very least it gives RM a very strong hand after this 3 year deal.
