:hmmmm It does sort of make you wonder when they expect someone to go into the Locker train for one full day, two part days and then run the locker by himself with less than a years service and no experience of sorting :cuppa

tragictramp wrote:Well the dom rang me this morning, waffled on about my fit for work form being given to me last week and i should be back working and he had an issue with this, i said im still in pain etc, he said that being in the den i wont be walking more than 100m, i wont be stood up for more than a few mins, and i wont be driving or doing heavy labour, i said ill be stood up all day and he said its periodical collecting the parcels. After arguing i agreed to go in tomorrow, but said if i am in any pain i will duly leave.

Ill have a word with my union rep before i start and tell him i dont find the position suitable and see what he says, i may ask for them to put in writing that they want me to work in the callers office.

The fit for work form was done over the phone, and i got this on works request in advance of returning.
Thing is once your in and you go off again another term of absence is registered in the PSP system even if your sick record is good you can find yourself on a stage 3 very soon! Good luck and all the best.

Well, went and done an hour and half in the callers office, spoke to my union rep and had a meeting with the dom saying its not suitable, as i had not sat down in an hour and half, all he could offer was sorting on nights which would enable me to sit down and i agreed, it now looks like they are trying to rob me of my day off, my rotating day off is friday, monday was classed as sick, and they expect me to work tonight/wed/thu/fri, this means that i am having no day off. I didnt realise this until i was on my way home, ill speak to my rep and see what the score is.

My would have been don't go in at all until you are ready, don't let them intimidate you into coming in, they will use psychological blackmail as was previously mentioned they only care about their bonus and getting the mail out, you're just a number to them mate, when you do eventually get back to work, the Equality Act 2010 applies here for you are now disabled and adjustment must be made for you and also insist on a staged return to work so you can bed in to a new duty pattern, instead of doing it all at once, walk before you run (if you excuse the pun)

Have I missed something?
If it is cartilage damage then it is easily remedied by surgery and there is no possibility of claiming disability under the Equality Act.

just tell your manager what you can and cant do then stick to that , if he/she wants more out of you politely tell them that they will have to put that in writing and you add your objections to the same document then if you should injure yourself and have to go back sick :chuckle it would be classed as accident at work and not be counted to your sick

No clash, you've missed nothing :Very Happy
You’re disabled under the Equality Act 2010 if you have a physical or mental impairment that has a ‘substantial’ and ‘long-term’ negative effect on your ability to do normal daily activities.
What ‘substantial’ and ‘long-term’ mean
‘substantial’ is more than minor or trivial - eg it takes much longer than it usually would to complete a daily task like getting dressed
‘long-term’ means 12 months or more - eg a breathing condition that develops as a result of a lung infection

There are/were two folk who were put on 'light' duties in our callers office recently....one had a back issue....one had dodgy feet....having worked in our callers office myself before I was surprised to say the least both these posties were put there in the first place as I would hardly call box counter work light!lol

This applies to the OP case, hopefully he can use this act to help him.

How does it apply?
Have you got personal knowledge of the case?
Because from what he has posted on here, it doesn't.

No NWpostie, this doesn't apply to the OP, tragictramp.
May i be as bold as to suggest you're getting confused with ‘substantial’ and ‘long-term’, it's AND not OR.
tragictramp's condition is a painful one, but certainly not one that's been around for 12 months. This Act won't be able to help him at the moment but rest and the right treatment will. Oh, and the caller's office is not the place for tragictramp to be for light duties either, me thinks.
