From the end of July 2013 workers in the UK* will be required to pay fees not only to submit an application to the Employment Tribunal and Employment Appeal Tribunal but a further fee if the claim goes to full hearing.


"The introduction of such fees will seriously hinder a claimant's ability to access the tribunal system and is yet another Coalition Government attack on workers' employment rights especially when you consider the employer pays nothing!" said Tony Rupa, head of CWU legal services.

The implementation of these fees is still subject to necessary Parliamentary approval but it is expected this will be granted and the fee structure be applicable from Monday 29th July 2013.

Claimants will now have to pay an issue fee of £160 or £250 when submitting their ET1 Tribunal application form and an additional fee of either £230 or £950 if the claim goes to a full hearing. The fees vary depending on the type of claim. The respondent (the employer) does not have to pay any fees.

"The CWU is currently considering its position regarding the impact this change to the tribunal system will have, not only on individuals, but the wider financial implications for the union as a whole.

"In the meantime we would urge any branches dealing with members' tribunal applications to get these processed in the normal way prior to the 29th July in order to avoid being caught by the new fee structure," said Tony.

That's one way to reduce the number of ET's, make it expensive for people. If you have been sacked, especially unfairly, then you are very unlikely to be able to afford to file an ET1 without the unions backing. And they tend not to back people these days. So the person in question would kind of be punished twice, by losing their job and then not having the ability to make any kind of challenge, even though they may very well be entirely innocent.
Another strike against the working class.

And don't forget that the Tory bastards have also upped the cost to £20,000 if you lose your case and have costs awarded against you and also they have given judges directions to award more of these costs for you have the temerity to bring a claim against a bad employer. :no no :roll:

There is a danger that if there is no outlet for genuine grievances, they may well take direct action such as assault on the manager, a campaign of harassments, damage the manager's personal property or worse. A man with nothing to lose is a very dangerous man indeed.

I agree. But then the individual in question will be further punished, though this time under the criminal process.
As you say, if you have no legal recourse available to you, for whatever reason, you may very take the only action left to you. After all, it's someone's life we're talking about, and a job loss can easily destroy it.
