£1,075 damages for CWU member against media group

Our claim on behalf of a CWU member against a large telecoms service provider was settled amicably at £1,075.

A Royal Mail postal worker was going about routine deliveries to the Wollaton Avenue area of Nottingham on 26 May 2011. Without warning of any obstruction or problem, the worker tripped on a small manhole cover which had become dislodged.

The worker's union, the CWU, asked us to pursue a claim for compensation, and we made enquiries locally in order to confirm what precisely had happened.

Residents told us that Virgin Media had recently been carrying out work in the area, and it was apparent that the company had not left the path in a safe state on completion.

We alleged that the firm had failed to return the highway to a safe condition for pedestrians after work was completed; had caused the pavement to become a danger; and had failed to erect warnings, notices or barriers. All these breaches had exposed our client to a foreseeable risk of injury.

We sent a letter of claim to Virgin Media, who romptly denied liability. However, the defendant subsequently accepted responsibility for our client’s mishap and the personal injury claim, finally agreed at £1,075, was settled amicably.

The accident had caused our client to sustain grazing and bruising to his knees and hands, and he continues to suffer pain in his left knee.

Oh, I hope their grazed knee gets better soon. Do they want someone to kiss his poor knee better?

They had an exciting time while denying liability :shock: :nervous :chuckle :chuckle
