But you didn't sign for the duty so it wasn't yours, it was just one you where doing (along with the OT), I'm sorry to be the bearer of bad news but I doubt you can do anything beyond trying to just do the delivery or collection and try to get get as much OT as you can.Family1 wrote:Just doing the same role for the last four years, and as i stated the manager had the duty up for picking without even concluding the case.
How can that even remotely been seen as fair.

I'm with DGP1 on this - you may have been doing the duty long term but in reality it WAS a vacant duty and the manager put it up - so you lost the duty which would have been the case on a repick on seniority. It has been a favourite of managers to use the callers office as a stop gap for ill health and this has obviously gone on longer then it should have. It could also be that the manager has taken the hump and put it up as a vacancy, which it was.
As to the accusation, if there was a reasonable doubt then there was little they could do but investigate and in your own words there was no evidence which in itself doesn't prove innocence.

when you was put on this duty after your accident was it classed as light duties.
also was the duty a full-time or part-time contract before you had your accident.

It may be worth investigating whether a president has been set by the fact that you have been on this duty for four years and it is very obvious that the manager has filled your role whilst you have been suspended, but this should only have been as a temporary measure. As overtime is not guaranteed unless written into your contract, I doubt whether you can claim for loss of earnings.

It seems you have been treated with great disrespect by your employer.
As you had been working the locker duty for 4 years you should have been given this duty permanently. Duties are treated the same as substitutions and promotions. If you were filling a vacancy that was expected to be vacant for longer than 13 weeks you should have been temporarily assigned this duty. After 3 months the duty should have been advertised. It wasn't but that is not your fault. After two years you should have been given this duty permanently. You weren't but you should be the permanent duty holder.
When you were suspended, your duty should have been filled by a substitute for 13 weeks and by a temporary duty holder if your suspension lasted longer than 13 weeks. Your duty was given to someone else before your case had been decided and as a result, you have lost money. You should put in a grievance for unlawful deduction of wages and follow this up with an employment tribunal claim.
You are disabled but your employer is refusing to make the reasonable adjustments they used to. If you can prove that you are still as disabled as before, you should put in a claim for discrimination. Speak to a no win, no fee lawyer. They are queuing up to shaft Royal Mail.
If they had a reasonable belief that you were stealing, they would have sacked you. It's not hard for them to justify reasonable belief so there must be some strong evidence that proves your innocence. What was the relationship like between your accuser and management?
