Thanks for all your replys people. I have been told by my solicitor that I won't be doing time do this as it my first offence he sai if they did convict me the worst it will be is a fine or community service so I'm not that worried its just annoying as I have been proper set up. Just so you all know its common assualt they are taking me to court with they tried to pin abh on me but the crown prossecution service said that it is not abh just common assualt. Acording to my solicitor he said that they will have a hard time getting there conviction on me because of the lack in evidence. Does anyone recommend that I tell my line manager before I go to court or after I have been and been given the verdict? Thanks

The code also requires employees to inform their manager if they are charged with, or summonsed to appear in court in relation to, a criminal offence (with the exception of minor road traffic violations).

the panel rejected Ms Wilson's appeal against dismissal because of her failure to inform the employer of the charges
Ultimately the decision is yours...but if you don't and you are caught out for any reason dishonesty on top of a charge for common assault would pretty much ensure a P45.
It's a serious risk to take.

If it was me I'd tell him, he cannot really do anything until after the case is heard and then I would imagine you'll be fine.
Long before my time here it was a charge of gbh, then downgraded to abh then downgraded again to common assault it was on a civilian and in a foreign country and the army dealt with me.......leniently, so with a bit of luck the common assault may be dropped if there was insufficient evidence, basically it was a fight. Good luck.

A guy at our place got done for drug possession and I said it's better to make the DOM aware as I think it's in your contract.
He did that and it was fine. Turned out the police also notified Royal Mail - so I'm sure the 'notifiable' bit is followed up on.
I don't think you can be sacked for this issue - just dishonesty or bringing RM into disrepute would be a problem. Although you can't always trust managers or expect equal treatment.
