yeah will be on phone to area rep tomorrow AM

just feel like crap, and hate the fact the manager who summary dismissed me, brought all new things to the table which is petty i believe but backed up his claim
that i didnt take my job or managers seriously

also went on to say i deceived my managers etc, the guy who started the claim i was going home early etc is the guy who dismissed me in 2007, and the other thing is he lied that he never knew i had a major offence, but in actual fact he did and he just blatently lied.

Lying and backing each other up with more lies, is sadly a common tactic by Managers. You need to take this to ET, and get a letter from your Doctor confirming that this situation is making you ill.

Do i take it too ET before an appeal or after the appeal outcome?

trying to get in touch with union reps is a nightmare, calling but no answer

one thing i did want to enquire
this case has taken 4 months or so to deal with and come to this outcome!!
so i was working pretty much every day, is there a time limit the company should adhere by?

Apply for the ET now - if your internal appeal is succesful then you can withdraw it. However, don't forget the rules have/or are changing on costs so read up on that first.

looks like they are using the instance of the first case to back up the second case.

Their thinking is we have "sound reasoning" because he was given a serious for the previous instance so has previous.

all they need is half a chance or even an opportunist chance to try this on.

if the clock card wasnt working thats their opportunist chance.

had you gone to tribunal the first time and won they wouldnt be bothering you imo.

if the union take it on no costs
if you go to a no win no fee...no costs.

the court will only ask for a deposit if they think you are a risk.

as far as im aware the cost hasnt kicked in yet.

i was due my second tribunal in dec and i enquired about the possible cost.

could be after march

okay got it :) about the ET.

on another note is it true once you have been summarily dismissed, and you appeal that regardless the outcome will still be dismissal,
once out not allowed back type thing?

It's not an absolute written in stone, but I believe if you win the ET and they are instructed to re-instate you, but either fail to, or decline to do so, then there is a financial penalty/award to take this into account. Will check and post in here as an edit when I find a link:
