AWR qualified bank holiday & annual leave

From 2009 all agency workers were entitled to minimum 5.6 weeks (28 days) statutory holiday, this normally included 8 bank holiday days. The calculation for casuals is accrued.
In 2009 the Royal mail new starter contract was four and a half weeks (22.5 days) holiday plus bank holidays (Bank holidays are automatically paid without the need to book)

The new AWR legislation states workers are entitled to the same holiday as the hirers employees after 12 week qualification.
The legislation also says what is included in "pay" means;
Above the statutory
minimum, can be given
as leave or paid in lieu
as part of the hourly/daily
rate or at end of assignment

Does anyone know if their is an element of holiday pay included in the hourly rate.

I received a letter from Angard about what was included in the pay rate - after many months of requesting information on how the pay rate matches the permanents salary pay and having to involve John Duncan before they would tell me. There is an amount that is supposed to cover the extra holidays the permanents get.

I have obtained this response from payroll.
Be aware angard have advised that shift allowance is not included in
gross when calculating holiday pay.


The calculation of 12.07% is, as you have correctly stated, based on the
statutory minimum. As this calculation is built into our software for all
workers across Angard we are unable to change this when you qualify for
AWR. Because of this, your AWR rate is worked out slightly higher than
permanent workers at Royal Mail, to pay you in lieu for the extra holiday
pay that you are now owed.

Why do they make everything so complex. The amount that is supposed to be in the pay rate was down as an additional payment due to them having more holidays not because they cant pay shift rate for holidays.

It is a straight forward calculation and there is no reason why it should not incorporate shift rate payments - if they did it would be easier as whatever calculation they use would then work for AWR and none AWR. It is meant to be a percentage of whatever we earn. Seems more complex to work out one figure for our pay then another for our holiday pay.

This edited reply from Angard staffing support manager confirms
shift allowance point.

Holiday is accrued at a rate of 12.07% of Gross Pay and this is presented
at an average of the booking rates for the shifts which you are deployed
to; please note that the booking rate will likely differ from your actual
rate of pay as the booking rate is the standard rate with no shift
allowances applied. Regardless of the rate used, the total amount of
holiday accrued will always be the same; i.e. you could accrue 15 hours at
£7.50 an hour or 10 hours at £11.25 an hour. Holiday pay then does become
more complex when looking over a period of weeks where pay is at differing
rates, please see below a worked example.

I know shift allowance appeared separately on payslip when i was employed as opg.

I totally agree with your view that everything is complicated from my experience
in resolving pay errors & holiday rate queries due to confusion & delay in
communication from Angard payroll..

The basic way that I used to do it was I would expect £1 in holiday pay for every £8 I earnt. So when I managed with AWR to get onto around £13 an hour. I would treat this like I was earning £14.63 an hour and so on. They never adjusted my rate of 6.08 per hour but simply gave me more hours which I was pleased with as it gave me more ammunition in sorting out holiday. In the end though all good things had to come to an end as despite the good wage I got fed up with the treatment with regards to shift patterns.

It's daft that shift allowance is not listed seperately on the wage slip

It's daft there is no longer reference to holiday accrued on the wage slip

So to sum up

Our wage slips are daft.
