So many people asking can they! and what are the Union doing about it,well i've contacted the Union and they have yet to reply. :roll:
Done some diggin and here's what i got.
According to RM there's nothing you can do about it,below is a templet of the letter your DIM will give you if "Anyone writes to you(DIM) saying that they disagree with the new working times,and therefore intend to come to work at their existing start time"

But I think they are saying it's already in the contracts so there is no change. Has anyone got a copy of their contract to hand? I know mine said I could be asked to work in any site at any time even though this was never imposed. My contract was last written in 2000 but my start in the 80's had a very similar clause.

You may have a problem at work because your employer wants to change the contract. In effect it is a proposal to change the contract of employment if, for example, your employer wants to:-


change the type of work that you do
change your place of work
cut your pay
change the number of hours you work.
Can I point out that nothing in the above applies, if you are employed on a 40/30/20 etc contract so long as your weekly hourage isn't reduced or increased they can change the start and finishing times till the cows come home. They have changed the start times at our office for several long servers who effectively now sit in duty's that are finishing later than people with less seniority than them - same scenario - unless you can show that the start or finish times will impact your work place or personal circumstances RM can and obviously do impose time changes.


Now where the dilemma comes in is how the heck can flexi time work with a maximum weekly contract - so if your reduced to PT working in the summer months - I cannot see how you can be made to do a week of ten hours (example) when it would exceed your weekly contracted hours.

I am surprised that this is being forced through as I really thought that this was a serious change in your contract - I was never employed to do 40 X 53 =2,120 hours per year, maybe this is where the "banked hourage will come in - its all too bloody confusing and doing my flipping head in :mad

Can someone in the know please enlighten me!!!!

Your written contract may state you must skin two squirrels whilst stuffing a beetroot up your left nostril at 10:55 am , but unless that is your usual task at the time you usually perform it , then it is legally null and void. It is all distraction, bullshit baffles brains :Very Happy

It all comes down to a collective agreement,in other words you have instructed the union to act on your behalf.
Bearing in mind RM are clever at distorting information,i.e. colleague shares,that are not actually shares,but profit
related pay.
yes,they have to give you reasonable notice of any change,but this has seemingly been done through the union,and/or
on a notice board.
but the fact is your contractual hours have not changed,it is simply your shift time that has altered,as RM say this is
down to new legislation,and in the best interests of the business(delivery best practice)i fear the union can only appeal
to RM's better nature.
The standard letter that Postman has added would be intended for those that oppose the later starts not for those that
are unable,there is a subtle difference.
Your employer should offer you an alternative,however i'd be prepared to fight your own corner because i don't
sense much support from the union.

I understand this but the EU want people working a 35hour week eventually as it stands we can work no more than 48hours with a ten hour break in between maximum shifts - so theoretically we could work 14hr shifts providing we get the 10 hours break and a complete 24 hours every five or six days isn't it.

What I don't get is how can they max a full time postie to 48 if there contract is a 40 hour week? and with the monthly pay are they going to even out those hours over the month or is it like they say annualized will we still get our pay as it stands at the moment but every forth week or will it go up and down with the hourage you do - if the latter is the case - best I leave now - this is unworkable and totally against family's how the heck are you supposed to survive on PT hours in the summer months and then get Christmas sorted with kiddies etc in the winter - this is Harri Kari to family posties - and with out any pay incentive alas this is the end if we give in just as well sling our hooks now.
