if you run out of fuel in a diesel the engine has to be flushed or something you cannot just put fuel in and off you go so i was lead to believe its a sackable offence

so what do you do with your own car when its nearly empty ? why would anyone drive a vehicle and not fill it up knowing that it is empty.

If you look under the bonnet, there's a hand pump. Drivers manual clearly states that , amongst many other things , that it is your responsibility to ensure there is enough fuel to complete your journey.
Unless for some reason you are forced to take a massive diversion then I can't see how you would be able to excuse yourself if you ran out.
While leaving a van with very little fuel in it is inconsiderate and annoying , the prior driver hasn't strictly broken any rules, as a previous poster has said, just put enough in for yourself, that way you also work within the rules. Alternatively ask the other driver not to do it again

If a van is left empty and im using it next day. I happily go and get fuel. Being a 9am starter I barely get enough time in the day anyway so I cut off. Happy days.
