if you sign the opt out you can work up to 70 hours a week. if you don't sign the opt out you can only do a maximum of 48 hours a week, but it can be averaged over the 17 weeks, so you could have some weeks where you do say 55 as long as some weeks you only did 41 hours, as long as long as don't do more than 816 hours over the 17 weeks

that is correct, it is averaged out over a 17 week period which i said in post 6 but it is royal mail policy for an 11 hour break between shifts unless it falls on a rest day and remember you have to have a 24 hour break once a week

You are entitled to it but you dont have to take it
royal mail policy is for an 11 hour break between shifts and 24 hour break minimum each week
i got that so called DUFF information from the royal mail safety director
that is royal mail POLICY running along side the working time legislation

Oh keith if you had actually bothered to read the agreement that sets out that policy, you would realise there's a whole load more information that tells you that its actually ok to work without 11 hour break or 24 hour weekly rest, just think you should actually get your facts right before you give poor advice without knowing all the details

The way it was told to us was that you must have a clear break of 11 hours .
I don't think there is a maximum number of hours you are allowed to work in a 24 hour period, but there is a minimum break of 11 hours that must be taken before and after. (You could work 23 hours in one day and start again 11 hours later)

The entitlements to rest and leave contained within the Working Time Directive are enforced through the employment tribunal system.
Who exactly is going to instigate an employment tribunal in this case?
The WTD provides rights for employees but like all rights if you choose to ignore them there isn't a lot anyone can do.

please tell me where, and in what royal mail agreement it states the policy you mention to confirm your argument/reasoning
that is in black and white cold hard print

if you worked a 16 hour shift in a mail centre you could arrange something with them regarding taking your breaks
if they wanted you to do a double shift they would be amenable.
but its is worth remembering that the do and mail centre are separate.
how should a do manager feel about letting you start at 6.30 in stead of 6.00
because you choose work overtime somewhere else?
was it paid break you were after ?out of the do managers budget which is seperate from the other.
sorry to sound so negative,but you choose to do this thing ,its not the doms fault
any more than its the mail centre managers fault.
talk to the mailcentre manager and see if you can take a 20minute break closer to finish.
you insist on your rights as you see them you risk losing your overtime.

Oh as for healthy debate you regularly quote things as fact and not just opinion and the like but it seems on a fairly regular basis to not be based on fact and is indeed just your opinion which seems to be often wrong which is confusing as you keep claiming to have a degree in employment law but don't even seem to know how the working time directive applies correctly

my i ask are you a rep, staff member/manager,/ a failed postman who just sits inside all day as you never have anything constructive to say
i withdraw being a rep as it is obvious you have not had any diversity traning so either a manager or a want to be manager/failed postman

Just putting in my tuppence worth, don't think anyone should be allowed to do that much overtime! What are your contracted hours? Think up to 50/55 hrs a week total working week is ok, but how many other short contract staff could do with that bit extra?
