I am writing in response to your recent requests for information dated 21 April 2012 which has been considered under the terms of the Freedom of Information Act 2000. You requested the following information:
“…how many appeals have been lodged against Royal Mail for unfair dismissal?” and;
“of these appeals, how many of them resulted in success for the applicant?””
Whilst we are unable to obtain figures for 2009, we can provide information for 2010 and 2011. All conduct cases and related penalty decisions are dealt with in line with the Royal Mail Group Conduct Code Agreement. Under the terms of the agreement, and in line with the Equality Act 2010, all employees are entitled to appeal against any penalty imposed. If an appeal is made, the case will be reviewed by an Appeals Manager who will make a decision whether to uphold the originally imposed penalty or reduce this penalty based on the existing information, and any further investigations they conduct.
During 2010 a total of 632 individuals appealed against a decision to dismiss them; in 136 cases the appeal was upheld or the disciplinary penalty was reduced. The number of appeals lodged in 2011 was 775: our records show that 202 individuals had their appeal upheld or the disciplinary penalty reduced from dismissal.
You can look at it that way or you can look at it this way, if they try again and no doubt they will! It just strengthens my case the next time i put a e.t in, and then the money goes up for me! Happy days.
