They've already suggested that already red robbo but it wasnt 10 k it was 3500 .I'm not being bullied into withdrawing by them . Rm have made mistakes and they need to answer why they've come to there decision when clearly there's Been flaws in their investigation which led up to my dismissal . It's a matter of principal red robbo not money . Like someone else posted they will gets pound a week .

The only way you will get stiffed like that is if the judge(s) and NOT weightmans thinks you've acted either vexatious or brought a claim that was doomed to fail.....and saying that you would have more than likely to have been to a CMD before a main hearing then the judge will give you a big hint if he thinks you have a weak case by making you pay a deposit to take your case further!

The figures for people being made to pay cost is tiny compared to the number of tribunal claims :roll: :roll: .....wankmans and other legal knobjockeys like to use the cost bolloxs to frighten people into dropping their claims as most people are decent law abiding people who probably have never set foot in a court nevermind had to deal with a set of lying,twisted low life arsewipes. :cuppa

Look I know everyone who gets dismissed by Royal Mail expect a union to reprsent them at a Employment Tribunal but it is simply not possible. Why reprsentation at tribunals cost lots of money even for trained panel members as preparation work takes time. The CWU now use a panel of reps and some retired members to reprsent someone at Tribunals and is trying to increase the number of people on the panel.

The CWU do use solictors and barristers in high profile cases like Burslem etc.

But any union must have a thresehold on what cases the union takes on and currently that stands on whether a panel member believes it has an higher then 50 % possiblity of winning.

Attendance cases are differcult to win as clearly their is an agreement on. As someone who has done a significant number of tribunals it is times consuming and differcult as your normally up against a trained solictor or a barrister but Royal Mail have a unlimited of money for this.

The CWU do represent successfully an hell of a lot of members but the sad thing a lot of members lose cases and thats with or without the CWU reprsenting them.

Good luck on your case and remember the Tribunal is there for Royal Mail to prove they have acted fairly in dismissing you and it was within the bounds of reasonable decisions. It is different from a protenial dismissal hearing and an appeal where you have to put reasons why you should not be dismissed.

Well at least I generated some reaction to the debate, reading the quote you can be ordered to pay for costs, and being out of job how would you pay for the deposit, no help from the union either as previously quoted ? :wave

Red robbo who said I was out of work . Yes I got dismissed , but I found alternative employment .who said I had to pay a deposit it's down to the judge at the pre hearing to determine that . Just because the union doesn't want to back the case doesn't mean it's not winnable . Union looked at my case and seen wether they followed proper procedures which rm did .I'm not fighting on that . It's the errors rm have made which should have been investigated more thoroughly . Being told in their investigation I was on a stage 3 in 2010 when on my attendance sheet I wasnt event on a stage . Appeals manager refers to this numerous times into her findings . Her words not mine we gave you a chance in 2010 to improve your attendance and clearly you haven't met royal mail standards so after serious consideration I agree with the original decision to dismiss . Massive error my friend this is one error they've made and believe me there's more . My point onthis red robbo if she had the right information would she have cone to the same conclusion and she needs to answer that question plus many more in her error stricken investigation .

We could save more money and more jobs by getting to grips with Royal Mail's application of the two agreements that cause the problems in the first place.
There is too much reliance on Royal Mail adhering to the "spirit" of both agreements and as you are well aware if you have experience of tribunals "spirit" is practically meaningless in law.
Both agreements need to be firmed up to allow the words to protect members more.
Mitigating circumstances are more or less ignored in the attendance agreement,the recognition of genuine mistakes in the Conduct Code exactly the same.
Neither have any clear definition or even rough guidelines which as good as renders them useless.
Member's job security is then decided by what kind of manager you have and what kind of mood they happen to be in.
The appeals procedure is also flawed,Royal Mail simply use it as a liability test now.
It needs to be based on taking a fresh look into a dismissal not just reading over the notes and rubber stamping the previous managers decision if it looks like a "safe" dismissal.

You really seem to go out of your way to help people here RR? Costs are very rarely awarded against the claimant something like 0.05%

the most i have known the claimant has had to pay into the court from an application by the respondant is £500

and even then the judge will advise if the claim is vexatious

RR everyone's entitled to an opinion m8 . I've had great advice on this thread by people who understand the tribunal process better than myself . I hope your never in this position m8 because it's not a nice place to be when you know you've been wronged by rm .
