I am confused about annual leave entitlement whilst on long term sick leave. I was off for ten months and during that time had five weeks annual leave booked. I was told I could claim payment in lieu instead of carrying over that much leave as I already purchase extra, and the new year leave has begun anyway.
Because I received full pay whilst off for the first six months during which three weeks annual leave fell, having already been paid for being off, I effectively "lose" my annual leave. Someone said I can claim pay in lieu, but I have already been paid so I don't get it. Sorry about the blonde moment it is just something someone said at work last night that has made me wonder if I am losing out here

That is not strictly true,usually the AL is bumped on to the next year which would be this year,you have not lost it.Because I received full pay whilst off for the first six months during which three weeks annual leave fell, having already been paid for being off, I effectively "lose" my annual leave. I've had peeps at my place who were off long term,they came back,then kept on going off on AL as they had built up so much up.
Not sure about the pay in lieu thing,I thought that was illegal,or at least against 'our' rules,not 100% tho.

Thanks Postman for your reply. I may have confused the issue further. What has happened is I was told I could have pay in lieu of annual leave, and they paid me three weeks, no mention of the other remaining two, despite an email asking. When I returned to work, I found that I am being deducted for annual leave purchase for this and next year as I buy two extra weeks, however they have not allocated me any dates as I was on sick leave and they didn't think I was returning.
I was talking to a work mate and she said you had your full pay whilst you were on the sick, during which the leave period fell so you wouldn't get paid twice. That sounded ok, I am not greedy. However, later that evening, someone else said to me that I still haven't had my annual leave even though I was paid for being on the sick and I am losing out. Had I spoken to the union rep etc. I am just trying to clarify when I am off on the sick and on annual leave, does the pay I receive for the full pay whilst sick cover the annual leave I was due, or am I able to claim back the pay in lieu for the leave I haven't taken?

To clarify you would not be double paid as such,sick pay is different to holiday pay.
You occur holiday even when you are sick,re my previous post.
The pay in lieu is a new one to me,if they don't play ball and pay the rest,take them,has to be better than working.
