An appeal by a North Yorkshire man against his conviction for murdering his postmistress wife is to be heard next month, it has been confirmed.
Robin Garbutt, 45, was jailed for at least 20 years for killing Diana as she slept in the living quarters above Melsonby Village Shop and Post Office.
The 45-year-old beat his wife to death in March 2010 but blamed intruders, Teesside Crown Court was told.
The Court of Appeal hearing has been set for 15 May, his solicitor said.
Garbutt's sister Sallie Wood said his conviction for the murder of 40-year-old Mr Garbutt was a "terrible miscarriage of justice".
However, sentencing him in April 2011, Mr Justice Openshaw said Garbutt's lies had been exposed as "pure humbug".
