If you've got SA, you get paid a lump sum every 6 months to cover the SA you miss out on when on leave.
Working that same SA instead of staying away from the office is not only against the Way Forward Agreement, it also could be construed as fraud to be paid twice for the same hourage.

Ok the offices this is going on in, are all union members happy with other members breaking national agreement if not why are they not raising this issue with there rep.
Who should then raise this issue in writing to the DIM quoting the way forward agreement and asking for it to be stopped.
If the it continues contact the branch .Sometimes the members have to look at themselves as they are as much the CWU as there rep who is only there spokes person.
But a rep with his finger on the pulse would have already acted and education is the key.

in our area the local rep and area rep have signed off the duties with full knowledge that this is happening, some of the members have complained to branch that they are losing out to extra hours, part time staff are not able to get all of these hours to increase their weekly wage as the full time members of staff who have signed for these duties are getting paid twice for the same hours, area rep is doing the same and doesnt want to lose out himself, branch have knocked back the complaint saying its a local issue that they dont want involved inExrep wrote:Ok the offices this is going on in, are all union members happy with other members breaking national agreement if not why are they not raising this issue with there rep.

I'm sure that those Members would have a negligible effect on Union numbers so I'll pass them their coats on the way out! Hold on a minute S/A is not attached to a duty . If your rep an area rep are in cohoots to cream off the S/A and they are not listening to your issue and neither is the branch contact your divisional rep if they dont listen contact bob gibson.
Then if theres anyone in your office who will stand for rep have a vote of no confidence in your current rep and get this issue sorted.
Has your DIM attached the S/A to duties so they havnt got the headache each day of trying to cover the S/A i know this is how it used to be done including my office.
If your office stands for this then they have no place to argue .How many unhappy members are in your office that are grumbling and rightly so over this.
Abuse of power springs to mind here.

S/A is open to everyone in our office on a daily basis at least this way its fair to the whole office .
I would of expected a unit rep and area rep to feel the same,sadly doesnt seem to be the case here.
I would still contact div rep and explain the situ may be a pointless exercise but at least you would of tried.

How can you have SA open to anyone on a daily basis? That totally defeats the whole point of having SA instead of normal overtime. The whole point of SA is that you are contracted to perform that work for one year (except AL or day off) and in return for providing more reliable cover for the OT work you get an enhanced rate of pay (although lets be honest it is only a few pence more).

Right or wrong,anyone could of had it built in.

My point is the higher SA rate is to reflect the fact that you should be contracted to do it for a year. If the work is being covered ad-hoc on a daily basis then it should be paid at standard OT rate not SA. As per the Way Forward agreement:
"Enhanced rates for SA will continue to reflect the benefits of stable and reliable cover. These will only be paid where the conditions of the existing national agreement are met (i.e. each attendance is scheduled to a nominated employee and substitute for the year, and is paid on the basis of hours actually worked, excluding breaks except of Sundays). SA will be limited to no more than 12 hours per employee in any week."
