I was put on a stage 3 warning when I went sick after christmas with bronchitis, was referred to ATOS etc.

so 10 days ago I had my interview about it.

area Manager came over to do interview as our dim is not ranked high enough to do them!!!

he said that even though the ATOS report had been in my favour he may still decide to sack me.

so I then stated that back in Nov 2010 I pulled a calf muscle in my leg and reported it to the PHG man as the Manager had gone home for the day, I also left a letter to be given to the manager on his return the next day stating what had hapened and to put it in the accident book, then this past November 2011 I slipped on a wet / mossy pavement and cut all my shin and knee up ( I was still wearing shorts ) but this time it did go through ERICA.

However, the area dom stated that my AOD in nov 2011 that I was part compable for the accident as my shoes were a little bit low on grip but not massivly so. he also stated that I had been given a copy of the findings of the investigation ( I had not recieved anything at all )

so I said that I do not agree with the AOD not getting reported in Nov 2011 ( this triggered my stage one ) and that I had not recieved any documentation about the ERICA report in Nov 2011 )

Yesterday the Area Manager came to our DO with the result of his deliberation.

he stated that the Nov 2010 AOD should have NOT beed classed as an illness and the stage one should not have been issues and that as I did not recieve any paperwork about the AOD in nov 2011 then both would not count against me, as he did not want RM to be taken to court for a case of unfair dismassal ( which I would have done and told hm so )

so I have now been placed back to a stage one as of last wednesday.

So even though you may be up for a stage 3 dismissal interview, make sure that they have done everything correctly because if they have not they can't issue stage warnings etc to you.

Both DOM's who balls'd up with the AOD's recieved bollockings so all is good in the world.

royal mail will do you for not following procedure, so you return the complement

thats why you fill out the erica reports, have back to work interviews (risk assessmants etc)

its for your protection
