What a prick Dom are im working my notice period . I finish march 13 . I've got to take my holidays in that period . I'm owed 6 days holiday and guess what Dom refusing to let me take my holiday in my notice period . Unbelievable his reasoning is there's no free weeks for u to take your holiday . If I dont take them in my period of notice i think I'll lose 6 days holiday pay . w*****s

Jayfin you will need to add the loss of holiday pay in your ET there is box on the form for you to tick.

yes

they will send you and order.
read it properly and keep an eye on the timeframe....especially if you are representing yourself.
Dont be afraid to ring the tribunal if you are unsure of procedures regarding the dates.....i phone them once a week on average lol

the date will probably be moved......mine was.
you can object but it will probably not get you anywhere.
if you want the date changed they will object thats for sure.

get a no win no fee
if there isnt too uch in the case they will more than likely take it on......mine had a lot in and i was running late due to the union bizzarely turning the case down to represent me.
try and get this sorted early doors

if you are representing yourself you can get some kind of advice on here....there are a couple of gems who may reply to threads.

i tend to take a peek and might be able to oint you on the odd thing.

Cheers m8 same to you my friend , don't know wether the union representing me I'm meeting up in a few days with the area rep , Im staying calm because I do feel like I've got a good case especially in one of there errors , that they keep referring to a stage 3 in 2010 which I never triggered I was on stage 1 .

Have you sent a copy of your ET to the Union HQ for their perusal ?

Forgot to ask have the employer sent you their response to your ET yet if so give that to your rep to send off as well.

I didn't know they had to send me a response , just thought they had to respond to the et . New to et never been Unfairly dismissed before so its a minefield to me

Yes the employere have 28 days to respond to your submitted ET, the content of the response will be their explanation to the tribunal why your dismissal was fair.

Jayfin you have only just started your ET case,what did you expect them do,they are not going to admit they did anything wrong ....i bet you their responce ET3 just said that all the way through,these lot will be counting on you to give up,that is what wankmans do! They try and grind you down until you feel hopeless and alone...fear not there are people who are going through it,have been through it. and come out the other side,what have you got to lose you have already lost your job.!!.
You might just win your case and get some dosh or you might lose, so what!!!
Unless you go around being an arse in your dealings with the tribunal case your not going to lose anything despite wankmans sabre rattling about cost.

Do NOT get down in the dumps and think ah feck it I won't win anyway,fortune favours the brave!

forget the change.

just get your paperwork in order.

the tribunal will send you an order soon which should tell you what you want as a remedy ,when you have to agree the bundle and exchange witness statements.

if you get a solicitor whether it be through the union or not they will more than likely take control and ask you before it needs to be done.

i dont know how many notes you have in your case but mine was quite big...nearly 200 pages in the bundle.

if you do end up taking the case on by yourself the tribunal will be more understanding about the deadlines as long as you keep them and the respondents solicitors informed.

seriously dont worry.

get advice from the local union even off here.
if you dont get taken on by the cwu solicitors still dont despair.

i wasnt even asked in for a chat....i suspect they looked at the paperwork and couldnt make head or tail of it all.
they missed out at least 4 major points which contradict the respondents case.

i also had serious doubts about continuing.....but when you get asked by possible employers to get two references higher up from your last job you realise that the unfairness hasnt stopped so I decided to fight on.

as it turns out i finally got advice from head union who looked through it and pointed me in the right direction in regards as to how to write the witness statement and to what they have done wrong.

im doing the case by myself
im not scared....just those pre match butterflies

the judge will be understanding if you do take it on yourself so dont despair.
