I believe union and rm have secretly agreed ona number , rm don't have to make an announcement About job losses and the union don't have to be seen to be doing something about it . So the bigwigs have agreed if any worker gets to stage 3 and there's no mitigating factors your going to be sacked , that's why the union not fighting as strong as they should be , because both parties have agreed x amount of workers have got to go and this is a discreet way of doing it . Rm get what they want and the union doesn't have to stand up for to them .

Found out yesterday I lost my appeal ,still don't agree with the investigation the appeal manager it's completely biased towards them , alot what was brought up doesn't seem to be investigated , errors in a plenty , I've been to a solicitor to get a neutral opinion and he agrees there's enough errors and procedures they should have done by law under health and safety which they haven't done , so my questions r why hasn't she picked up on these and what do I do know . I've submitted my et but I want my job , if I can c the errors and a outside solicitor can c these why isn't the appeal manager and the union rep who represented me not seeing them

Jayfin I think you no what the answer is, as bad as it is for you. RM don't have to give you your job back to you even if you win at the ET. An ET will be independant unlike RM

Not really independant is it? But thats RM for you. Im only suprised that the appeal was carried out quite quick and you have the result.

Firstly let me say that I'm sorry that you lost your appeal.
As you can tell from the majority of the answers I gave in your Topic(s) I'm not wholly surprised. You had to have a solid argument to combine with your discrepancies in order to make a good case. Your main argument was based around whether your medical condition should have been identified by your Manager for future recurrences.

An Employment Tribunal may look at:
- Should the pattern of recurrence have been identified by your Employer.
- Were you were given a reasonable opportunity to inform your Employer of the recurring condition.

Totally confused , reading my appeal notes , the appeal manager keeps making reference to a stage 3 which I had in 2010 I've triple checked my sick notes , and Ihadnt triggered a stage 3 i was on a stage 1 in July 2010 , because you have had two stage 3 hearings 2010 and 2011 I abide by the original decision dismissal her last sentence in her notes , it's totally wrong as I said I was on stage 1 leading up to my stage 3 resulting in dismissal , what do I do . it's a massive error isn't it

Yes your right phoned him today , and he was blasé about it , like he wasn't interested , I just don't know what to do except et . You'd think rm would lose at an et with a obvious mistake like that , but I don't understand why the union isn't fighting it . So fecking frustrated .
