What happened was one of our drivers was detained for about 20 mins while they went over his whole vehicle including engine bay and load space, at the time he was still on the highway and not MOD land. Given that we are told if stopped by the police and they want to search the vehicle we either have to wait for a manager to attend or drive to the nearest RM site and do the search there, I don't see why the military should have the right to be going through the mail. This is also just normal service personel not MPs or MOD police
Ive only driven on to a MOD property once which was in my private car and that was given a quick search.
I suppose I can see the logic in searching a RM van but as others have said they do not have the authority to actually open any mail.
However this is going to take time each day and needs to be accounted for within the duty time and included any overtime if necessary.

in the circusmtances you describe yes they do have the power to search, they can go over the whole van, check its entire contents even open the mail(some might disagree with that statement but they do) they can check every single inch of the vehicle for a threat, but and heres the but, only if he is entering the mod property, the driver has the right to change his mind at anytime and say not to bother and drive away but not onto the property, they dont need to be inside the gates when doing the search, just he has the intention of entering the mod site, the also dont have the power to detain in order to carry out the search so the driver is free to leave at anytime
Also to add it doesnt matter if its mod plod or not, they are the guard on the camp or gate, they are resposible for vehicle let into the base, also using the word detained is misleading, he was not detained he was held up, detained would imply he was not allowed to leave, he was.

Aldershot is mostly owned by the MOD and there is a sign that if you enter the area, you may be searched by the MOD Police, I would assume this will include RM vehicles, if we were exempt any Terrorist will twig that fact and hijack an RM vehicle and use it as a VIED, this will include Salisbury plains training area (SPTA), both are quite open and there is quite a lot of civilian traffic going through, so vigilance is needed.

Re: Do the military have authority to search a RM vehicle?
Sometime it is not necessary for the RM vehicle to enter the premises, he can hand the mail to the duty NCO and pass it on to Camp HQ, same with a pizza order the delivery guy don't go past the gate, he just hands it to us and bugger off (after being paid of course)zx135 wrote:PhilthyPhil wrote:Sorry I should have been clearer, I mean a checkpoint when entering MOD property. you will prob find that the people on the gates of milltary bases, camps etc are mod police
they have the same powers as regular police so there is no durisdiction issue
on entering these places and a condition of entering is that they reserve the right to do the search

In this case they are not MOD Police, or Military Police, just normal squaddies.

Re: Do the military have authority to search a RM vehicle?
Extremely unlikely - Mod Plods don't guard bases except in rare and specialized cases.keithposty wrote:you will prob find that the people on the gates of military bases, camps etc are mod police
Almost all barracks and military bases are guarded by ordinary Servicemen/women. All service personnel are trained in how to conduct vehicle searches and the legal aspects of it. Also there will be contact between the local police and the military and both sides will be fully informed of what the national and local security levels are as this also has a bearing on searches as well.

Re: Do the military have authority to search a RM vehicle?
I think the confusion comes with joint responsibility sites.
Rosyth Dockyard main entrance is guarded by armed MOD police officers because strictly speaking it's a privately owned dockyard.
The adjacent Naval Support base HMS Caledonia is guarded by service personnel only because it's a military base.

Refuse, say you've not got the time for a search and explain that they can, with correct identification, collect the mail from your Delivery Office.PhilthyPhil wrote:Sorry I should have been clearer, I mean a checkpoint when entering MOD property. MOD soldiers can search outer and inner of any vehicle, however cannot OPEN mail,as once a soldier did just that, and low behold was sued in court as seeminly the mail contained sensative medical records.

sorry thats bollocks, armed force personnel are allowed to inspect the enitre vehicle and its entire contents if they so wish, but again only if the postie is intending to take the vehicle onto the premises, he can refuse and they wont search but they wont let him on site,
no soldier has ever been sued for searching a vehicle and inspecting its contents for explosives
