As a regular RM casual transferred to AnGREED I was informed that as a Business As Usual (BAU) that I did not need to claim my holiday pay and would continue to accrue time and select when I wanted it - this came from Julie Hinchliffe (Opertations Director) via the Northampton call centre.
I have now been paid all my Holiday pay I have accrued since I started with AnGREED . I was saving it up for my Holidays or to take in the summer when casual work decreases to about half a day per week at my mail centre. The holiday pay is not at the correct pay rate as the underpayment of rates to take my Christmas pay from 6.08 to 6.35 has not been incorporated into my holiday pay rate. I do appear to have received all my underpayments in this new pay slip. I told them the underpayment was not being incoporated into my holiday pay rate after my first underpaynent was paid to me at the end of December.
Does this mean I will be getting my P45 and no longer an employee of AnGREED - I have some work for next week though
Same here again Verging. Holiday pay was my "pot" didn't ask for it to be paid. Ho hum needed the car MOT'd so it did come in handy! As to the rate of pay...where to start!!
£6.08? £6.35? £6.58? more..higher higher. I have given up. I want the rate I was on pre AnGREED and breaks paid for.
I'm still trying to get a final answer on the AWC issues. I asked for the info on 4th Jan so just waiting for the 28 days to elapse before I go further...by LAW you should be told one way or another by either the employer or agency how you stand or you are in breach of the AWC rules and can then go further down the ET route.
BTW I never did get a copy of a contract from AnGREED last year are you the same?
I just got my payslip and after thinking I had been underpaid again it now shows I was not paid my wages for the week at all! I have been Paid all my holiday pay which I also did not ask for! I phoned to be told everyone has been paid their holiday pay this week!! Why?
Angard are legally obliged to pay your holiday pay at your normal pay rate. There are online calculators to help you work out how many hours of holiday entitlement you have accrued. Angard have probably paid you only minimum wage, you have a right to demand your holiday entitlement is paid at the normal rate you earned while working for them.

I have two contracts now. I had to pester for it as my start date was always incorrect. Got it sent eventually still with incorrect start date - could not read the name of the AnGREED person who signed it. I then pestered again to get the start date corrected so go a new contract with correct start date.
They did inform other people at the mail centre I work at - they were not sending them out automatically as stated in the original letter and would only send them out if people asked for their's.

My rates have varied. As a long term casual my normal rates are 6.08 (7.58 Sundays - was on £10.64 prior to AnGREED) : at Christmas rates were 6.35 (8.45 for Sunday's). So some of my holiday should be at 6.08, 6.58, 7.58, 8.45 dependent upon hours I worked at each rate.
This does not account for corrections that should be made with respect to letter LTB 1076/11 - they claim RM said we would go back to our rates prior to AnGREED and the additional benefits we should get as a result of AWR. I would not want to be the person working out all the back pay, back holiday pay, addtional hours needed to recompense for breaks not taken etc - when/if they finally determine our rights as a result of AWR. I can and will work it out, once the entitlements are known, to make sure mine is correct but to determine for all casuals will take someone who knows exactly what they are doing (dont forget each mail centre had different pay rates at Christmas for premium times, some people were kept on basic pay rather than Christmas rates etc). Maybe I should apply as I am well qualified to do it for them but do I want the headache it will cause me.
Yes, I've had mine too and yet another one of those pay statements, i know we shouldnt moan considering at least we have been paid but its just another example of them not having a clue what they are doing!!!
...our holiday pay rate should be an average of our hourly rate so say for some hours you get £6.08 and other hours £6.48 for example your holiday rate will be £6.28

It will not be an average it depends on the number of hours worked at each rate.
Example
24 hours @ 6.08 worked = holiday of 3 hours @ 6.08 = 18.24
48 hours @ 6.35 worked = holiday of 6 hours @ 6.35 = 38.10
Now the Totals would be
72 hours @ 6.26 worked = holiday of 9 hours @ 6.26 = 56.34
A straight forward average of 6.08 and 6.35 would give a rate of 6.21 or 6.22 so the holiday pay using average rate in this case would be 55.89 or 55.98 - dependent upon using 6.21 and 6.22 respecitvely.
Yes, me too! Had some money paid into my account during the week, knew it was short, but without a payslip couldn't say exactly why, but guessed that it was 1 day + difference in hourly rates. Yesterday the payslip arrived & 2 payments had been paid into my bank. The second one being holiday pay. Looking at the payslip, I was right, one shift short + the difference between the wrong hourly rate after 10pm. At least the infamous 2nd week had finally been paid. Why do they have to make things so difficult? I had emailed a very clear document with all my dates & hours worked & "this is what you owe me" ..... they got the first two weeks sorted then....wrong! Another email to be sent!
