Just phoned the ACAS helpline before filling out an ET1 and I was told that an ET1 was the only way forward BECAUSE ANGARD WILL NOT RETURN THEIR CALLS OR SPEAK TO THEM!!!! Their arrogance is staggering.
Has any one actually by passed the ET and gone straight to a small claims court???? If so can you post some details esp if asking for more than wages due [ie bank overdraft charges etc]
I was paid at the wrong rate so they owe me £126 there
Holiday pay £150
They ignored my tax code and took £226 from the one pay slip I have of £1045 Even emergency tax is 20% where did they get £226 from???
My NI is wrong too
They did some how manage to get my hours right tho, lucky me

At over £1k I suspect you go beyond 20% and partly into the higher tax bracket of 40% - after all 53 weeks at £1k+ will go into the higher tax bracket. The fact it should have been split over a number of weeks will be irrelevant as it all got paid in one week.

If things go correctly you should get:
an ACAS representative to abitrate your claim (you may want to instruct a solicitor to act on your behalf).
Angard will be sent ET1 form and documentation*
You will get a date for your Tribunal.
You either settle our of court or have the tribunal.
* if recent threads are to go by Angard will claim they have not received the documentation and have the Tribunal date postponed to a later date.
Note: You may get paid correctly in the mean time and Angard will hope you cancel the ET1. They may also promise you will get paid and ask you to cancel the ET1 (before you get paid).

I submitted an ET1 online over the weekend. Email reply received today - hearing set for 26th March. Easy enough to complete - itemise all your hours worked and what you should be paid.
