Exactly.
This is not a "the sender might be at it" it's up to them to refund and claim situation.
This is a 100% RM at fault,can't get out of it situation.
I wouldn't accept poxy stamps either. :cuppa

Totally, but it's the way ebay and Paypal works unfortunately. But as sender paid by cheque... moot point. Has the tracking been checked again? Cos surely that will say something. Better to check on internal system rather than one customers use tho.

The track and Trace was done again 3 days ago and also popped back into the Castle Brom D.O...all the T & T says is attempted delivery, go to D.O to collect or phone xxx to re-arrange delivery. At D.O they said cannot find so must be lost.

Any idea how she stands re compensation from R.M?? Told her to get a P58 but she says D.O only open 8am -12.30 except Weds(Or possibly Thur) when open later. This doesn't sound right to me, my D.O was open till at least 15.00 except Sats

Surely re the compo, she can get a print out of the amount paid to the sender via her bank, as that name should be on the recorded delivery receipt etc

Also, is nothing to say it was via ebay(although it was)

And something else I found interesting.......the D.O worker said that 'this' postman was renowned for 'losing' parcels hmmmm :nervous

Item xxxxxx could not be delivered on 23/11/11 10:39 (and no Safeplace option was specified by the addressee). A"something for you card" will have been delivered, the item will be returned to CASTLE BROMWICH pending instructions from the addressee. You can arrange a redelivery online, call the CASTLE BROMWICH office to arrange a re-delivery, or collect the item from CASTLE BROMWICH by bringing proof of identification and address.

Again it all comes under the DSR. Goods have not arrived. Therefore the sender could claim royal mail. I know it's wrong, but that's the way it works.
According to the Sale and Supply of Goods to Consumer Regulations 2002 the goods remain at the seller’s risk until they are delivered to the consumer. Thus the supplier is liable should the goods not arrive.
