OK ill explain why we got the days back it was because if you were off sick for a full week you hadnt banked a day off and when it was your rota week you were only entitled to 5 days off instead of six so it worked both ways :nana

You don't need a link.
You don't get paid for your rotation week so there is nothing to claim back.

Because if your right, and you can provide proof from a National Agreement, we can then go to our DOMS and Reps and get back what we are entitled to.

Most of the people on here who comment about agreements tend to post a quote from that agreement and either provide a link to it, or name it. What you do with that is then up to you.

Come on bringon, your not that naive from what you have posted previously. Of course no Manager will believe you if you don't provide the evidence which is why I asked you for a link. You could say the sky was blue at Midday and they would still need evidence to back it up, they always have and always will.

RMC and its members can only provide you with the information, its up to each individual what they do with the information, and how far they want to push it. There is another option if your manager does not implement an agreement, go to your rep, area rep, div rep and CWU HQ of course how far you push a point, and how much commitment you make is an individual choice.

you were entitled to the six days off, 5 from previous weeks and the one from the rota week off, so by your information, if i am off sick for a week then i am entitked to get two days back? my rota day off and sunday because i was sick on both of those days and didnt get them?

no i dont thinks so!

Your rota week off is exactly the same as being ill on your day off you dont get it back, you are only entitled to get annual leave back if your ill over a period of annual leave

Ah I see the problem now!!

The original poster asked if he would be entitled to the FULL week back if sick on rota week off!! and we said no and you said yes, that's why we were disagreeing with you!

As for being sick on a week your working six days then yeah you might be able to argue for a day for that I think but not sure on that

I asked as extra hours are worked each week which are carried over to pay you for your rotation week off,(approx 6 hrs 45 p/w)
If you are sick you will receive sick pay, so surely the extra hours worked should be paid as OT or the week can be claimed back?

No.
If you are sick on your rotation week you don't get sick pay....because you don't get any pay for that week.
The wages you receive that week are the banked hours from the previous 5 weeks.

Please excuse my silly answer above.

It's even more difficult for term-time only workers! My understanding is that you are not expected to work any shortfall or be compensated for any illness during your scheduled time off. It's the same situation for people who work 4 day weeks etc.

I normally work Mon-Fri 35 hours. If I'm ill on a Monday then it's 7 hours. If my colleague also works 35 hours but on a 4 day pattern mon-thurs and is ill on the monday it would be 8.75 hours, he would not be expected to work back the 1.75 hours.

There is no need for any adjustment to attendances because of working days lost to sickness. Obviously there is also no need for recording any sickness on days off during the sixth ‘off’ week (which is equivalent to sickness at a weekend for someone who works a Monday to Friday job), if no working days are affected.
