Apple's decision to dismiss a retail store employee who violated company policy by posting negative comments about the company on Facebook has been upheld by a U.K. Employment Tribunal. The employee, known only as Crisp, had appealed to the Tribunal because the posts had been made to a private Facebook page
Crisp was fired for gross misconduct when the posts were passed along to the manager of his Apple Store by a coworker. Crisp argued that the dismissal was unfair because the messages were private, but the tribunal ruled that the communication was not protected because friends could have easily copied and shared it (as one "un-friend" obviously did, outing him).
As such, Crisp’s comments were not protected by the right to privacy contained in Article 8 of the European Convention on Human Rights. While the tribunal said that Crisp did have the right to freedom of expression under Article 10 of the same convention, it noted that Apple successfully argued that it was justified in limiting this right to protect its reputation against potentially damaging posts.
Key to the decision, according to Jamie Hamnett of the law firm Addleshaw Goddard LLP, is that Apple "had made it absolutely plain throughout the induction process that commentary on Apple products, or critical remarks about the brand, were strictly prohibited." In addition, the tribunal noted that "such comments would be particularly damaging for Apple as image is so central to its success."
Apple is extremely protective of its image and brand, as witnessed by its lawsuits against anything even remotely resembling infringement on any of its products or logos.
While Apple retail employees are not prohibited from posting on the Internet, they cannot include Apple's name in their posts, or mention their employment at Apple.

I've never liked Apple, I think they're worse than the dreaded Microsoft but they get away with it because they think their products are trendy.

They gave me a new ipod and a 3 month warranty when my old one became a bit temperamental once the warranty had ended. I can't see many companies doing that.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.
