You should have a rep present for all attendance procedure interviews.
Any mitigating circumstances need to be raised so even if they don't stop the issuing of stage 1 and 2, they can be used if it goes to a dismissal interview.
A stage 1 is just a stage 3 by a different name at a different time.

Any manager ignorant enough to push you through the attendance procedure while you father is dying from cancer will not listen to mitigation.
That is why it's important to have your rep with you,document everything and if the worst happens and it gets to stage 3,appeal or ET you are prepared to expose this manager for the scum that he is.

mitigating circumstance - (law) - a circumstance that does not exonerate a person but which reduces the penalty associated with the offence information that should be kept in mind when making a decision.

In laymen's terms, not the reason that something happened, but an explanation of the circumstances and situation at the time.

mitigating circumstance - (law) - a circumstance that does not exonerate a person but which reduces the penalty associated with the offence information that should be kept in mind when making a decision.

In laymen's terms, not the reason that something happened, but an explanation of the circumstances and situation at the time.
i felt at the time i shouldnt have had that stage one and told them so,in the period that was in question 4 days i spent with my dad as he died, then 5 days a little later bought on by dehydration [you wouldnt believe the knock on effects when stress is added to that] bought on by getting stitched up at work ,was told that to attend my dads funeral had to swap my day off ,which i did turned up to do that duty only to find they had changed it to another arrived office 7am ish got out gone 11 no map no water no advice 9 bags no idea where i was finished at 4/5 with 25 min cycle back the round had loads of maisonettes in the middle of no where ................

yes it went on my sick record and i ended up with a stage one with that period involved, i wasnt very happy and told them what i thought of the whole set up didnt matter still went thru, and to add insult to injury it was there fault i was ill , :cry
I got the same. Was off with a knee problem and was signed off on to light duties but despite twice agreeing with the manager on light duties, the next day I got told there was no light duties and sent home again both times until they eventually realised I was going to be sitting at home for months and did accommodate me. I got my second stage warning despite arguing that I tried to come back twice and got sent home.

Just to make sure you are fully aware of what can happen. They can still issue the stages, the mitigating circumstances should be mentioned during the interview so that if they do decide to issue a stage 1 or 2 then when it gets to a stage 3, or an appeal against a dismissal, the deciding manager is fully aware of the situation and can they decide what is and what is not appropriate.

BTW RM Special leave allows for days off for Blood relatives funerals so you should not have had to swap a day off, they should have given it to you. Also when you attended your father in his last few days that should also have been Special leave as well - no way they should have been included in any count towards a stage. Yes mentioned as mitigating circumstances as they may have had an effect on your health but nothing beyond that.

many thanks for that info .well over a year has passed now and the stage 1 has been wiped off now ,i have since then never worked an hour over on delivery for them and never will !!!
