A member has recently returned early from a career break and could only get a 10 hour saturday duty. She has subsequently taken 3 saturdays off on sick and management are now telling her she is being put back on her career break. I've never heard of this and to me they're breaching her contract. Surely if they accepted her back albeit on reduced hours she has been brought back on contract that would give her the full rights and responsibilities as any other member of staff. If anyone can shed some light I would appreciate it.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

If they have agreed to let her come back early from her career break and she has been put back on pay roll then she has to be treated like every other member of staff .

Career breaks are an individual choice which employees have a right to request ,RM can not put someone out on a career break .At worst they can use the Attendance Procedure,if she has broke the standards .

She'll need to lodge a grievance before ultimately going to a tribunal ,for amongst other things , breach of contract,I would even throw in sexual discrimination,if she's been off sick for "women's problems ". You should also go to Disagreement for missuse of their own Careers Break Procedure ,which by the way ,states that if you have a bad sick record ,you are note eligible to apply.

Thanks Mal, Already got it sorted. Typical management up to there old tricks ie talking bull and thinking we would believe it. The rest is already under way, but much appreciated especially as HQ could only advise to contact our Personel expert at HQ who never replied to my email.
