Rest breaks - a break during your working day


As an adult worker (over 18), you will normally have the right to a 20 minute rest break if you are expected to work more than six hours at a stretch.

A lunch or coffee break can count as your rest break. Additional breaks might be given by your contract of employment. There is no statutory right to 'smoking breaks'.

The requirements are:

•the break must be in one block

•it cannot be taken off one end of the working day - it must be somewhere in the middle

•you are allowed to spend it away from the place on your employer's premises where you work

•your employer can say when the break must be taken, as long as it meets these conditions
it clearly states in this ruling, the break must be in ONE BLOCK. so they are breaking the law by breaking it into 2 parts, with one stuck on the end of the shift. the union has fought for years to get these conditions, and the fact now remains we are entitled to 40mins break through union negotiation. its not up to royal mail just to split your break up and put the remaining 20 mins on the back of ANYONES shift, and as i have said before, see what would happen if they did that with the breaks of m/c staff, or professional drivers. there would be ructions on. as for our revision, we,ve had our delivery methods revised, they are all 4.45min long with lightweight trolleys, and high capacity for the town centre, we are all on park and loop. and we,ve had the walk sequencing machines in since the end of july. i am sorry if i sound stroppy or sharp, but i dont mean it to be. its just this job and the way we are being tret has got the whole office riled up. and i,m not even there at the present!! i,m on sick leave. :sad:

They are not breaking the law, the part where it talks about the rest break being in one block means you have to be able to take a 20 minute break in one continous block not get it split into more than that, I don't agree with what they are doing but it is perfectly legal

the rep has told my mate today, that we are quite within our rights to take our full 40 mins when our break is due, they cant make you take half on the back of your shift. thats good nuff for me.

Where longer flexible spans are introduced (i.e. beyond the 3.5 hr current standard) duties should be constructed to allow the full 40 minutes meal break to be taken in full prior to departure or split into 20 minutes prior to and 20 minutes during delivery.
The actual pattern of breaks within these rules will be agreed locally.

It doesn't mention 20 minutes at the end.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

problem with that quote and the same problem with most agreements is its open to interpretation, main word of concern in there is should and also that the pattern of breaks agreed locally so again weak rep and members then management will try and get agreement for anything they like

Does the design of the duty allow staff to take part of their meal relief en route if required (before or at the middle of the delivery and not left to the end) or eat and drink in order to replenish their fluid and energy reserves?

Where necessary have breaks been planned at or before the middle of the delivery and not left till the end?


It is pretty clear that breaks should not wholly or in part be left to the end of the duty.
It is a H&S consideration and as we all know our H&S is the number one priority.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.
