Royal Mail in court over race discrimination case

A Lemington Spa Royal Mail parcels delivery driver who had more than 18 months off work over a five-year period is seeking compensation for race discrimination and unfair dismissal. The Royal Mail told the Birmingham Employment Tribunal that Jivan Sansoy, of Rylands Close, Leamington, had received numerous warnings before he was sacked in October last year for poor attendance.

Sansoy said he had taken time off because of the racist attitude of colleagues, domestic problems, stress and depression. The Royal Mail refuted this and denied the race discrimination allegation. It said it had not always been satisfied with the explanations he had offered for taking so much time off and had made strenuous efforts to help him.

Chris Andrew, appearing for Sansoy, said Sansoy had been picked on at work, prompting his race discrimination claim, although Sansoy admitted that he had never made a formal complaint. The Tribunal was told that Sansoy had been absent from work from April till October - more than 200 days - in his first year with Royal Mail and had been off for 114 days on another occasion, apart from individual days in between. In all he had missed 543 days' work in five years.

Sansoy told the Tribunal that he had requested a transfer and had not been given overtime. Royal Mail responded that when he had been given overtime he had failed to turn up for his shift.

And the bit i loved in the statement was...

Now wot was the STRENUOUS EFFORTS??? WOT HELP DID ANYONE GET WHEN FACED WITH ANY STAGE 1.. 2.. 3...???? TELL ME PLEASE ANYONE...????? OHHH You can ask to see the ATOS team and tell them any info and get councilling... But RM dont take a blind bit of notice.... Mark my words... I know this for real..... In my opinion its a load of bollox.... And another thing.... The "not being satisfied with explanations he offered for taking so much time off." I would of thought this Postie would of had Sick notes off of his GP to cover his absence>>>>??? So in this case RM CANT AND SHOULDNT MAKE ANY OPINION OVER THIS POSTIES EXPLANATIONS.... Coz the GP has.... And as ive been told..... As i recon most on here have been if under any Attendance procedure? " WE ARE NOT DR's AND WE DONT DISBELIEVE OR ARGUE THAT UR SICKNESS ISNT REAL OR NOT VALID..." BUT.... UNDER THE RM ATTENDANCE PROCEDURE YOU AINT COME UP TO THE STANDARD WE REQUIRE!!" This bloke has a individual case with its own merits but i bet a million to one that RM have f****d up somewhere along the line.....!!!!

This race card might or might not be a real issue but i bet again it is..... In My opinion!!!!

-The' strenuous attempts "to help would be a offer for Welfare or ATOS Origin EHS -that's rubbish . I do think RM have made a rod for thier own backs as there was dicktats to be "nice " to certain people after RM were threatened with Investigation by the CRE & EOC after Jermaine Lee and that Harlow ?? IT case , so there was orders from on high not to make trouble for RM . I've seen one on light duties after Tonsilitus and Wisdom Teeth removal, which of course was nothing to do with a relative taking RM to Court after dismissal. Now RM are trying to close ranks here and cover for thier holier than thou right on nonsense . Let's just say like most bullies, RM/ATOS Origin as RM's agents ;are careful who they pick a fight with.RM are just stonewalling trying to make things"look straight on paper "for a IT, to cover for thier botch -ups as Tommo says , they'd hide behind the OSA or RM being taken into disrepute .
