1: Why has the DIM not put this young lady in touch with ATTOS after all if i am not wrong that is what they are there for?
2: I s there no work at all in the office do we not have some dead's to do.
3: Surcharges or some form of work that the callers may not have time to do.
4: Tidy up the office rehang bags,put trays in York's
5: Sorting there must be something there to sort.
The list is endless,problem is the DIM would rather just ignore it because it is easy and to much like hard work,it would be better if he/she had this young lady in so she could feel useful rather than pay a member of staff to sit at home,it really is not that difficult to deal with.

if it was myself with a unhealthy heart i would be on the sick for as long as it takes rm wont care if you have a heart attack theyre not worth it think of your own health stuff the stage warnings i hope you make a speedy recovery

go get union solisitors on to it there free to use why not you pay you subs dont you but we had a lad in our office with same thing he was off for 6 months and light dutys manager could,nt do enough to help him

Of the 50,900 unfair dismissal claims brought by employees in 2009/10, 12,200 were withdrawn, 22,400 were settled by Acas and 3,900 struck out prior to a full hearing. Of the remainder, only 5,200 were successful at a tribunal and, in respect of the successful claims, the median award was £4,903 and the average award £9,120.

As said before by a few people ...... RM would prefer you to come back in ANY capacity .
MOST managers would try to help people on light duties as its daft not to because they have the fit note working for them .
BOTH times ive been off with ligament tears the bosses have been great . It really depends if your manager is an arse
and by the sounds of it he is .
Tell him you are NOT doing ANY walking ( if thats what your fit note says obv ) and if he insists then get to GP and he will take you back off sick GUARANTEED and THEN get onto the union solicitors and let them have a field day with him . Oh and TELL him as your leaving the office this is what your doing and his arse will hit the floor because deep down hes chancing his arm and youve just walked all over him .
As for shooting you down fish ............. i was having a laugh princess .

I may be wrong here, and I stand corrected if I am, but at this point, Katie was just asking for some genral advice re her situation--not looking for anything else, and hopefully she will do the sensible thing as been advised, i'e write in the first instance to DON. Have a good Sunday.

so 44 % got a settlement out of doing an ET1 and 24% either withdrew because they either had a weak case to begin with or the employer recitified the situation to their satisfaction.
8% was struck out at hearings probably because their case shouldn't have even got to that stage in the first place thats 76% which leaves 24% of that 10% was successful in an ET
So if you look at either being successful in a tribunal or getting a settlement then thats 54% chance you will come away with something.
Depends on how you want to spin it I suppose eh.
Fortune favours the brave and even if you do lose theres still the satisfaction that you would have cost them thouands in lawyers fees.If you do the work yourself it will cost you feck all despite the sabre rattling of Weightmans and all the other cocks that you should pay costs.

This is really admirable, Fishtank. The statistics are an important factor in deciding whether or not you should go ahead with a claim to the Employment Tribunal, however, it is necessary to interpret the statistics and not just to quote them.fishtank wrote:

Can the statistics tell us whether, of the 12,000 withdrawn cases, this was done on legal, or Union, advice, that the case would be likely to fail? Or on advice that the claim would fail because it was malicious or vexatious? Or, that the claim had been withdrawn because its submission to the ET prompted urgent dialogue between claimant and respondent which resulted in resolution of the problem, something which is very often the case?
The fact that 22.400 claims were settled by ACAS does not of itself imply that these cases should never have been brought to a Tribunal, nor that they were unsuccessful; far from it. Despite the case being referred to ACAS at the time that the claim is submitted to the ET, their involvement in the actual negotiations usually only begins at the eleventh hour when many cases are successfully settled to the benefit of the claimant via COT3 agreements which are legally binding on both the claimant and the respondent, Any failure by either party to adhere to the terms of the COT3 agreement can be swiftly resolved by a Court Order which can be obtained from the Tribunal.
Of the 3900 struck out prior to a full hearing, could many of these be as a result of some sort of resolution being reached at a Case Management Discussion, often ordered by the Tribunal Judge, where the two parties can meet to discuss the case in a less formal setting than a full Tribunal Hearing?
Of the remaining 12,400 cases, the 5,200 who won their cases represent a success rate of 42% but this figure is not representative of the true success rates of people who submit a claim to an Employment Tribunal.
In my opinion (and experience) the submission of a claim to an Employment Tribunal is not something which is carried out lightly, but is often a result of the failure of the employer to engage in any sort of dialogue with the employee, even to the point of completely disregarding their own Griervance Procedure.
What I would say to anyone with a problem with their employer is to follow the Grievance Procedure to the letter, even if the employer takes no notice of it. If you don't receive a satisfactory resolution to your grievance consider putting in a claim to the Employment Tribunal and, even if you get no Union backing, you can always go it alone as I, and many hundreds of others have done, and would do again, if it were necessary.
What is also important to note is that, even though the statistics show the median and mean of the awards made by the Tribunal, a claim is is very rarely about the amount of the award you might win but is more about having SOMEBODY address your grievance and stopping the unfair treatment.
This is not a criticsm of you, Fishtank, rather it is to demonstrate that statistics without any interpretation of the figures really mean very little and nobody should be put off fighting unfair treatment because of them..

Surely a claim can only be deemed successful if it is to the satisfaction of the employee and that is very difficult to judge...i know of one member on here who "won" his case but received no compensation at all nor his job back but still his case would be chalked up as a success.
My point throughout this has been that members should never see the Employment Tribunal system as anything other than a last resort,as you say for an ET to consider your case you must first exhaust the internal grievance procedure and that can mean that members are in a whole heap of trouble before they get to that point.
It's not a game and shouldn't be approached as such.

the first bit isnt actually true.
in a stage meeting recently a manager said that royal mail per area have a directive which determines whether they want people to come in on light duties or whther they "WANT" them off sick.
this changes due to needs apparently.
got to be highlighted imo for anyone who then gets a stage for a switch between lights and properly off.
