left my digi card in the van at the end of my duty by mistake but covered myself by getting locker person to write a letter to explain my cock-up in case i am stopped by the rozzers or vosa and thought that would be the end of it but last week our glorious leader decided to give me a written warning and explained that if i did it again in 12 months i would be taken down the conduct code.tosser!!!!!
any body else had this warning or is it just us poor unfortunates who have a complete and utter tosser in charge?

It sounds like you've done everything you could to remedy the situation. Was your card handed in, or did RM have to get you a replacement?
If they had to pay for a replacement, then I suppose I can understand them being angry. But a threat of disciplinary action, for what was a simple mistake, that anyone could have made?
That's excessive! And if the card was handed in, then WTF are they playing at?
They should be giving you credit for handling the situation well!

I have left my tacho card in the machine many times. It's usually handed in by the next driver and nobody gives a monkeys about it being left in the machine. I personally would speak to my union rep or division and call his bluff. I don't believe a genuine mistake that has caused no real problems can merit a written warning. Good luck.

Just to look at it in a different perspective,

You have made a mistake and have covered your ass by asking for a letter from the phg

As such there is now an official record of your mistake

Your boss has now covered his own ass by giving you a letter telling you that no action would be taken this time and not to do it again or action may be taken in the future

Basically you have both covered your asses and nothing has come of it, you have not been conducted and have been told you won't be for this incident,

I actually think your boss not really in the wrong here and even think if you hadn't insisted in a letter to cover yourself he wouldn't have done anything

Remember he is also responsible for your driving hours etc and would be liable for prosecution as well if he was allowing these sort of mistakes to happen on a regular basis

all good points but many of my colleagues have done this many times and 1 or 2 do it on a regular basis(at least once every 2-3 months) and as far as i know none of them have had a warning like this.
if i also point out that it is only 2 weeks since the conclusion of a grievance against this manager does it seem like a bit of pay back from this person(we do have a lively history)?
by the way the card was handed into our key locker when the next person started his shift 8 hours later(he also sent me a text to tell me about it) and i picked it up the following morning when i started my next shift.
as for replacing missing or lost cards we have been told that it is OUR resposibility to pay for a replacement card which has happened at least once that i know about.

the letter is a standard letter that is printed off when ever this happens(a lot)
there would be an official record of my mistake already on the system as the card is downloaded every day.
has this manager only given me this letter as payback?(see above)
these mistakes ARE happening on a regular basis but no conduct letters have been recieved by any one else.

Point 1- this simple mistake can affect the operators licence,thus reducing or banning altogether vehicles based at that depot,thus putting you out of work.So not just a minor mistake really.The managers will then be in the sh1t as well,for allowing you to do this without a written warning/acknowledgement.

Point 2-you didnt say if the card was on the work mode or not.If it was on rest, no problem,but if in work mode , you've bust your hours. So again -SERIOUS.

Point 3-not a hardcore criminal,but very amateurish.

Point 4-if you were in a job in the real world (heaven forbid), you'd get a written warning as well.

at my MC this happens frequently as well, however they cannot take you through conduct code for infrequent genuine mistakes.

they will if you leave it in like 3 times in a month (if the locker staff are annoyed enough to report it)

as regards the system, it doesn't tell you that a driver has left his card in until a week in lieu on Sunday (day might vary for depot to depot, my depots report were populated on sundays) after it happened, when the infringement reports come out, at which point you would have a daily rest (iirc, it's been awhile since I had to compile those things) infringement.Then your manager would take that report to you, and you would have to explain yourself to them, and you would get a telling off in line with the way infringements are handled at your depot.

With regards the documentation you carry if this does happen, a printout with your correct duty content and start/finish times, with your reason written onto it, should be sufficent. 2 copies should be made, 1 for your locker (retained for 15 months (read: whenever anyone is extremely bored and can be bothered to clear out the files), could be subject to local agreement) and 1 for yourself (to be retained for 28days, as with all other printouts).

your locker staff should file the printout away in your tacho file (every HGV driver should have one, whether they have submitted a manual entry or not), and add a comment to the erroneous digital data (since digital data cannot be superseded by manual entry, ever) saying that you forgot to take your card out of the tacho head, and to refer to the associated printout.

the above may vary depot to depot but the gist is the same.

tl;dr be nice to your locker staff and they won't drop you in it (at work and legally)

Bloke at our MC left it in the van on sat morning off nights and it was in all weekend. The only bit of grief he got was because the workshop moved it saturday afternoon so there were questions being asked why it was moved and was not just showing "other work" all weekend, he just kept saying it was a genuine mistake and it got dropped.

I was part of a group of drivers last week involved in a refresher course held by our workplace coaches and this scenario was discussed.
They told us that if this situation happened then if possible, 2 printouts should be taken and a manual entry was to be made on 1 of the printouts explaining the `busted` hours.
That printout would be held on record for 12 months. No mention of the conduct code was said.

get whoever does the manual CDU inputs,to put a note on the system stating what happened and that you were on rest for x amount of hours,keep your print out or wax disc til it due back and you should be covered
