what happens if they slow play the decision??Himaggen wrote:Just remember that if things do pan out to be worse than you'd hoped, an Employment Tribunal with truly independent decision makers should be your next port of call.
To ensure that an Employment Tribunal listens to the case, ensure that you submit your ET1 form within three months of the date of the alleged incident.

Run, rabbit run. Dig that hole, forget the sun.

Re: i,ve been charged with gross misconduct under the health
right ive been onto ACAS and found out the correct answer.
The incident is actually the sacking.
so you get 90 days minus one day to raise a tribunal case.
can only think the wording is assuming you are sacked on the same day.

Re: i,ve been charged with gross misconduct under the health
Be careful, the reason I mentioned it earlier is because an ET will not generally accept claims received after the three month time limit.
The three months can be from either the date that your employment ended or the matter you are complaining about happened. It is possible and and can be argued that you are complaining about action taken as a direct result of the 'driving' issue. Since the action against you began soon after the you were 'caught' the three months can be taken from there. You really do need to be careful, your complaint is not that you have been dismissed, since at the time of making the claim you haven't been. The complaint is that you have been treated unfairly because you found yourself in a situation in which each of your available options would result in disciplinary action against you.

best thing to do then is phone up ACAS.
explain the events to them and they will tell you whan the 1st day is.
they have told me in my case if i get sacked its from the day i get sacked.....because i havent been totally suspended from working.

Re: i,ve been charged with gross misconduct under the health
my union rep has told me the 2 nd manager who interviewed me,should not have re-interviwed me from scratch and has apparently told my rep that they (the management ) have breached disciplinary procedures !!!!!,so there apparently is no way i will be sacked and apparently this is why i have not heard anything in over 3 weeks!!!!!!!.

Keep a record of all of this, that is just poor procedure following unions and tribunals usually have then by the balls for this sort of thing, if they bugger up you are laughing, had a similar situation myself, accused me of willfull delay and charged me after fact finding interview, but they had no photos of alleged items I had brought back, hey presto case dropped, hope they make an arse of yours !
