I'll simply answer your question directly; Yes you can be dismissed for under-performance.

Have you ever seen or heard of anyone outside their 6 month probationary period being dismissed or even conducted purely for "under performance?

Back on topic... About 1998 we had guy who was painfully slow. He had chance after chance in the year he was with us. We even had to prep his walk on a fri/sat night so he didn't go over his time (10:15!!!!)sat morning. Don't forget this was when we didn't have sdd or had to take mailsort on a Saturday. When walks took around a hour to do. Ge was made to resign for being slow. He was in a rightstatr this frame when told.

He had chance after chance in the year he was with us.

Chances are he was still on his probationary period.
It's was normally extended beyond the 6 months if you were struggling to make the grade which he obviously was.
The point is,if you have worked for the company for,say 10 years without any performance issues and suddenly because RM decide to move the performance goalposts they try to move you out the door you would have a more than decent ET case.
RM know this and more importantly RM's legal team know this and that is why NCI is a non starter.
Members have plenty to worry about without worrying about the bogeyman.
