It is a standard clause in most Contracts of Employment that attendance under the influence of drink/drugs is Gross Misconduct regardless of the duties being performed.

Do bear in mind that in the cases above, hi-viz, helmets and keys, each and every employee, in my D.O at least, has received training and WTLL sessions which they have signed for/agreed to, stipulating that these are offences.

I doubt very much that driver/H&S training has taken place which stipulated the specific offence committed, and reasonably certain that the employee has been informed that failure to make timed collections or return by a specified deadline is not acceptable. Weighing up the two scenarios is a judgement call by the employee based on the information provided by their employer. Making an ill-judged decision under the conditions we have been presented with in this case suggests a lack of knowledge and/or decision making skills, both of which could be provided through re-training.

A written warning and re-training is the only responsible outcome of this case based on the information provided

Do you really think it's required to tell a test passed driver that driving on a flat tyre is dangerous?

What else? Driving on the pavements? Perhaps who to contact if you get a flat tyre yes, but they went over that with me on my changeover. Did they tell me not to drive away on it? No they didn't I guess they took it for granted that a competent driver would know that.

Surely somethings are so blatantly stupid you should know better. To go through all permutations would mean WTLL would go on for hours. Isn't it funny how we hate the "nanny state" for telling us what to do and eat all the time, but when things go wrong and we do something stupid we blame people for not telling us what to do.

He knew it was wrong, we know it was wrong and ultimately he foolishly owned up and told the managers he knew it was flat and drove on it regardless.

I have never said he should be sacked only that knowing RM it is a possibility, and it certainly still is, however unlikely it may seem. You mention the world "responsible". RM in my experience have never bothered about what's just, only what will save them hours.

had my hearing today,didn,t go very well i feel and was told i will get a decision in the post early next week!!!!,would not say anymore,how they love to keep you on tenderhooks!!!!!!!!!!!.the fella who took the meeting,reheard the whole case,wierd!!!and when mu union rep said the dom had recommended a non sacking punishment,he said that was only his opinion and it was up to him!!!!!!!!!!!!!!.21 years for what!!!!!,just a number is how i feel.

this is now the 3rd different manager to be involved with the hearing of this case,is that allowed!!!!!!!!!.

hey i have been suspended since MAY 7TH and since the fact finding interview on the 9th i have had ONE meeting (which was ajourned)
and no information at all ! :evil/mad

Just remember that if things do pan out to be worse than you'd hoped, an Employment Tribunal with truly independent decision makers should be your next port of call.

To ensure that an Employment Tribunal listens to the case, ensure that you submit your ET1 form within three months of the date of the alleged incident.

Remember the message I last posted…

Make sure that you complete an ET1 form, Royal Mail may hold off on a decision until your three months has elapsed, leaving you with no avenues to go down, (pardon the pun). (you can always withdraw your submission later should you get an outcome with which you are satisfied.)

Don't let anyone tell you any different, it is three months from the date of the incident not from the outcome of the hearing.

we had a postie at our office who waited 8 months thinking he was going to be sacked and the n he contacted the manager who held the interview and he claimed he forgot about it!!!!!!!!!!! and he was issued with a serious warning of 1 year!!!!!!!!!!!.
