ive spoke to my rep and my dom and they dont think they can do anything about it :no no

the contract date should of started as of the 18th of april when our final stage of the shared van change happened.. ive been doing the shared van thing for nearly 2 months i would of thought now as i was the first to start the new changes, it seems they are stringing out releasing the contracts, my rep said i should of recieved it within two weeks?

So, are they basically saying that they cant/wont pay for the hours you have worked? That really is not right and with or without Union support you are entitled ... Or have I missed something?

ermm my contract should of been changed by the point of me going on annual leave but they didnt. so they have only payed me part time hours for annual leave so im 9 hours short both weeks whih is a total of 18 hours and £10 in d2d supplements

Take it further,area rep/div rep,CWU HQ,don't take it lying down.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

Hi I joined royal mail in feb 2007 contracted as a 20 hour worker, I was told at interview that normally the hours would increase in time. I wanted a full time position but as this was all that was available I took the position, I have been on several duties but I always work at least 30 hours a week as I am also a driver. last year my average working week was 34 hours most of which I spent on a full time duty. I feel that it is entirelly unfair that when I have holidays I am only paid as a part timer. Does anyone know if there anyway I can get my contract changed or have this looked into? cheers

As well as providing a statutory amount of paid leave the Working Time Regulations also provide that a worker should receive a week's pay for a week's leave, and that the week's pay should be calculated in line with the Employment Rights Act 1996 (the ERA).

Employees who are contracted to 20 hours per week can be said to have normal working hours, and so the amount of pay they should receive is that which they would get if they worked those normal hours (S221 ERA). In addition to this S234 of the ERA specifically provides that in the case where an employee with normal working hours does overtime which takes them above those hours then this is not counted towards the calculation for a week's pay. However, if the overtime is contractual (i.e. you explicitly require an employee to do x hours of overtime per week in their contract) then these would count towards the normal working hours.

If an employee has no normal working hours or can in the case of a 1 hour contract show that it does not represent expected workload then the method of calculation is different. For them, a week's pay would be calculated by taking the average of their last 12 weeks earnings (S224 ERA). If they have consistently worked 40 hour weeks then they would receive pay at that rate.

As far as demanding holiday pay on overtime hours - you can demand all you like but have no legal basis for doing so and so are entirely in the hands of your employer. :neutral:

Hi thanks for your reply thankfully my hours have now been upped to 27.5 so its not as much of an issue

Crezz,

It looks like you have signed for a 30 hour a week duty with 9 hours Scheduled Attendance. Does your payslip say "weekday Scheduled Attendance"?

Scheduled Attendance is a form of compulsory overtime. They used to pay a lump sum twice a year to compensate for the money lost during annual leave weeks. I don't know if they still do this.

If you got a duty that existed before the re-pick and you are doing exactly the same work as the person who held the duty before you, 9 hours of your duty should not have been converted to SA. Even if your duty is a new one, it is worth finding out what part of your duty is SA.

mine has now been sorted, and i am now payed 39 hours a week
