im just after stories from other peoples experiances or knowledge here goes
5 weeks ago a packet sack 1/2 full was left at my frame by i think the night shift. after putting in my letters flats etc i went for the packet bag. i looked inside it , lifted out a large packet and then lifted it to empty on my frame. OUCH!!!! i pulled my back on the uplift , when i tipped it i found there was 18 big thick magazines at the bottom of the sack.
since that time i have just came out of hospital where i have had surgery on a bulging disc on my spine, not very nice believe me. . i have started the ball rolling with the cwu for compensation but i need to know
A. are the union good with AOD claims
B do i have grounds for a claim
AND C HOW MUCH YOU RECKON!!!

oh they reckon it could take 6 weeks before i can walk properly again!! and my nearest pub is 2 miles away!! :d'oh!

From what i can see.
You've picked the bag up not knowing the weight of it as you did not prep it,so i'm presuming it was overweight,which could be a good start,if you know what i mean.
You'll need witnesses which if there were is also a good thing.
Obviously the Manager has rigoursly enforced H&S at your place :wink: so somebodys arse is in for a kickin.

I've not had any experience of this but i'm sure others will know more.
Good luck with it and i would of thought you'd have a case.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

no witnesses as such but union rep counted all the magazines that came out of the bag and a screw took me to A&E

no home visit yet but im sure they will be round pushing me back to work soon!!

The rep should have weighed the bag in front of manager and both kept a record of it.

Exactly - if the sack has been placed there prior to your duty then the drop bag sorters must have been aware that it was overweight - and it should have been weighed - it should certainly have been weighed when the incident occurred - if all things are considered and H&S aspects have been followed it would be hard to claim as negligence.

The sack should have weighed no more than 11 kilos - though having worked on DBFs when several are sorting it is impossible to know who's thrown in which bag and how heavy it is.

union soicitors asked me about the weight of the bag etc and they were considering a reconstruction of the bag with the magazines etc as the packets were still left on my fram when i tippedd them out before going to A&E

One of my members has recently returned to duty after AOD. He had a henia through reaching down into a ALT to ge flats out of it. CWU legal+medical/solicitors are on the case!

£2500 plus loss of o/t xpenses etc for my injury came to just under £4000 total for my injury,mind you im covered in operation scars and only have 1/2 a left shoulder tendon and a knackered joint for my trouble,trust the sim/mill and dont take the first offer and count every penny you may have earned and track every cost,bus tickets parking,pills etc

(ii) First aider report.
(iii) Surgery record.
(iv) Foreman/supervisor accident report.
(v) Safety representatives accident report.
(vi) RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations) report to HSE.
(vii) Other communications between defendants and HSE.
(viii) Minutes of Health and Safety Committee meeting(s) where accident/matter considered.
(ix) Report to DSS.
(x) Documents listed above relative to any previous accident/matter identified by the claimant and relied upon as proof of negligence.
(xi) Earnings information where defendant is employer.

Documents produced to comply with requirements of the Management of Health and Safety at Work Regulations 1992 –
(i) Pre-accident Risk Assessment required by Regulation 3.
(ii) Post-accident Re-Assessment required by Regulation 3.
(iii) Accident Investigation Report prepared in implementing the requirements of Regulations 4, 6 and 9.
(iv) Health Surveillance Records in appropriate cases required by Regulation 5.
(v) Information provided to employees under Regulation 8.

its going back a while(9 years) and they paid me full basic pay and no sick record for the whole time i was off,just to ground your feet on compo claims the day my £4000 check landed a doctor got £250,000 compo for slander in the news,depends on what you are reckoned to have suffered and your long term affect on your life

For 250,000 I could put up with a helluva lot of slander!

As a serving soldier you are entitled to claim if you are wounded through a criminal act rather than an act of war. A colleague of mine was wounded in the upper arm - not too serious but there was a lot of tissue damage and some nerve damage - he received 7500 - some months later whilst reading a paper which shall remain nameless but comes out on a Sunday - a policewoman received 120,000 for having remarks made about her big knockers!!!!!

When it comes to compensation then the sword is certainly not mightier!

Compo is weird A member of my family overtook a van on a corner while on his motorcycle, the van was turning right so he went from about 40mph to 0 in about 9 feet aided by the side of the van. He went to an accident solicitor that specialised in motor vehicle claims and he hobbled away with 2 inches less leg, a big scar and £85K. He is not going to work again ever though.
