just spoke to my area union rep who is a great bloke and he said it is highly illegal to work your annual leave & book overtime as you are not insured to be doing the job! CASE CLOSED.

Erm no its not illegal in the slightest, the employers liability insurance covers you at all times when you are at work, he is talking rubbish

That's working hours not paid hours,some lucky people in other jobs get treble time for a 12hr sunday...that doesn't count as a 36hr day.

Searching around it seems it's not illegal as such,the only thing i could find was...
You are not allowed to exchange any untaken statutory holiday entitlement for pay. You must take all of your statutory holiday entitlement each year.

To be honest their is not a lot a rep can do.
The conversation goes like this...
Rep..."Member A is working through his annual leave"
DOM.."No he's not....he has swapped it"
Rep..."When has he swapped it to"
DOM..."That's nothing to do with you"
You stand up,boot the chair but there is f**k all you can do. :cuppa

Screws down our way got busted big time for this,the OPG's got paid for the docket AND got their leave days back.

No doubt it still goes on at other places though.

I'm still learning to be a rep. But correct me if I am wrong, but does a rep not have the right to view the holiday rota so plans can be made for cover ?
If so, the DOMs answer of "nothing to do with you" won't work.

At the weekly resource meeting you will get a breakdown of how many are on annual leave and long term sick for the following week or if you are really lucky...fortnight but no,you are not entitled to trawl through the holiday sheets to see who is off when and where...

They would have gone down to basic hourly rate after working 10 Hours :hmmmm :hmmmm :hmmmm :hmmmm

i have worked on a week off before and been paid at sa rate for every day...i was not aware of any agreement about not being allowed to work it and only did it the 1 week as i was due to have 2 weeks off and i didnt need it..My DOM begged me to work it
