So managment say "you can go home after you`ve prepped your walk and owe us OT or lose AL ect" and the gullible will say "OK then, thanks mate"........... Before this happens UNION MAN should step in and say NO!!!!...It is up to RM to SEND you home - which is completely different.

I was amazed at the amount of delivery staff taking half days holiday! Think if they had volunteered to work yhen they would have all been sent home as there deffo wasn't enough work for all of us!

If it was explained clearly to the members that they could go home ONLY if they paid back the hours and they were given the choice of staying then the rep can only advise them to stay...he can't physically stop them.
They are all supposed to be adults after all.

Yes I know what you mean but this could have been nipped in the bud and posties not put in the position where they are offered the chance to go home "on condition". If the union was on the ball and knew this stitch up was about to happen, then every one would have been ready to say " Are you sending me home?" It didn`t affect me but alarm bells rang straight away. If others fall for this its their problem but if it sets a precident then it becomes my problem and so it needs sorting out by the union.

I thought there were 'no' conditions but our lot still trying it on. If the workplace was closed the employer had to pay the contracted hours I thought? If though, you were offered work, you are out of luck.

If the staff had all agreed to stay on I bet the managers would have probably sent them home. After people volunteered to go early the managers could follow (very relieved). After all, if everyone agreed to stay on the managers would be forced to stay with you and they wouldn't want that.
In the end the workplace must be closed and no work available to make clawback illegal.

We were sent home early (around 9.30am) 4 days last week and there's no clawback other than shifting the backlogged mail, which took me an hour over my time for 1 day.
4 hours for one day sounds very harsh, we'd be owing 16 hours just for last week - plus we only took 1/3 of a walk Mon-Wed this week.

With a reasonable manager fair enough (swings n roundabouts). I agree, allegedly this practise could be 'tried out' on an naive office with a weak union presence. It's nothing more than a con to reduce the office overtime. Most in my office have accepted it no doubt leaving me to fall on the sword (again).

the majority of postal workers pay union dues so lets have a legal view as to our entitlements re this situation.come on cwu lets have some guidance as to what is the legallity of clawback under the current weather conditions

As I understannd it thats correct.
For instance:
DOM says: "OK there is no work left you may as well all go home - you'll owe us hours though" - Illegal.
DOM says: "Ok there is no work to do as its too dangerous to deliver. Anyone who wants to go home can but you'll owe us hours" - Legal as the necessary agreement of the employee was granted by them leaving early.
